ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 55 DESIGNATIONS OF TITLES AND DEPARTMENTS IN ALLIED MILITARY GOVERNMENT WHEREAS it is considered advisable to make certain changes in designations of titles and Departments now existing in Allied Military Government in the Free Territory of Trieste ; and WHEREAS it is desired to put into effect the prescribed changes and give due notice thereof to all concerned, within that part of the Free Territory of Trieste occupied by the British-United States Forces (hereinafter referred to as the „Zone“) : NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army, Senior Civil Affairs Officer, ORDER: ARTICLE I CHANGES IN DESIGNATIONS OR TITLES Section I. — The present designations or titles of „Senior Civil Affairs Officer“ and „Deputy Senior Civil Affairs Officer“, be and the same are hereby changed to „Director General, Civil Affairs“ and „Deputy Director General, Civil Affairs“, respectively. Section 2. ■— The present designation or title of „Senior Civil Affairs Police Ofiicer“ be and the same hereby is changed to „Director of Public Safety“. Section 3. ■— The present designation or title of „Deputy Senior Civil Affairs Police Officer“, be and the same is hereby changed to „Deputy Director of Public Safety“. Section 4. — The present designation of „Area Commissioner“ be and the same is hereby changed to „Zone Commissioner“. Section 5. —• The present designation or title of „Civil Affairs Officer“, be and the same is hereby changed to „Assistant Zone Commissioner“. ARTICLE II DIRECTORS AND EXECUTIVE DIRECTOR In addition to the Director General, Civil Affairs and his Deputy, there shall be five additional directors and one Executive Director for the Zone designated as follows : 1. Director of Public Safety, who shall also be the Chief, Department of Public Safety. 2. Director of the Port, who shall also be the Chief, Department of Transportation, which shall include the Free Port of Trieste. 3. Director of Finance, who shall also be the Chief, Department of Finance. 4. Director of Interior, who shall also be the Chief, Department of Interior. 5. Director of Economic Development. 6. Executive Director. ARTICLE III ASSUMPTION OF OFFICE I, RIDGELY GAITHER, Brigadier General, U. S. Army, do hereby assume the duties and functions of „Director General, Civil Affairs“. ARTICLE IV CREATION OF THE DEPARTMENT OF INTERIOR The following new department is heieby created and established : Department of Interior. Section 6. — The Utilities Section of the former Industry and Utilities Section or Division shall be hereafter designated as the Office of Utilities under the supervision of the Department of Industry. Section- 7. — The Office of Agriculture & Fisheries shall be responsible for Fishing, Forestry, and Animal Husbandry, in addition to the regular functions of Agriculture under the supervision of the Department of Industry. ARTICLE VI TRANSPORTATION AND PORT OF TRIESTE FUNCTIONS Section 1. — All surface, air, rail, and water transportation in the Zone, shall be under the supervision of the Chief, Department of Transportation. Section 2. — All Motor Transport functions shall be the direct responsibility of the Motor Transport Officer under the supervision of the Chief, Department of Transportation. Section 3. — The designation of Port Director referred to in Order No. 442, dated 11 September 1947, shall remain in full force and effect. ARTICLE X OVERSTAMPING PRINTED MATTERS The over-stamping or over-printing of forms, documents, stationery and other printed matters bearing the previous designations with the designations established by this Order, is hereby authorized. Army Director General, Civil Affairs Order No. 78 ADJUSTMENT OF ECONOMIC TREATMENT IN FAVOUR OF EMPLOYEES OF STATE ADMINISTRATIONS, OF LOCAL BODIES AND OF PUBLIC BODIES IS GENERAL WHEREAS it is considered advisable and necessary to adjust the economic treatment in favour of employees of State Administrations, of local Bodies within the Zone of the Free Territory of Trieste occupied by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army, Senior Civil Affairs Officer, ORDER: ARTICLE I PROVISIONS CONCERNING THE ECONOMIC TREATMENT OF EMPLOYEES OF STATE ADMINISTRATIONS, OF LOCAL BODIES AND OF PUBLIC BODIES IN GENERAL Section 1. — Except as otherwise provided in the following Sections of this Article, the provisions of the Legislative Decree of the Provisional Head of State of 5 August 1947, No. 778( hereinafter called „Decree“) issued by the Italian Government and relating to the adjustment of economic treatment in favour of employees of State Administrations, of local Bodies and of public Bodies in general, as well as the tables contained in the annexes of the above Decree, shall be extended pursuant to this Order to the Zone insofar as same are applicable. Section 2. — The words : „by Article I — second para — of the Legislative Decree of the Provisional Head of State of 25 October 1946, No. 263“, as contained in the second para of Article 2 of the Decree, are hereby deleted and shall be substituted by the following : „by Article II of Order No. 349 dated 26 April 1947.“ Section 3. — The words : „in the Decree of the Provisional Head of State of 12 December 1946, No. 585“, as contained in the second para of Article 3 of the Decree, are hereby deleted and shall be substituted by the following: „in Order No. 353 dated 19 April 1947.“ Section 4. — The words : „Article 8 of the Decree of the Provisional Head of State of 27 June 1946, No. 19,“ as contained in the last para of Article 3 of the Decree, are hereby deleted and shall be substituted by the following : „Article VIII of Order No. 217 dated 20 September 1946.“ Section 5. — The words : „by Article 10 of the Lieutenant’s Legislative Decree of 21 November 1943, No. 722, and by Article 6 of the Legislative Decree of the Provisional Head of State of 25 October 1946, No. 263“, as contained in Article 5 of the Decree, are hereby deleted and shall be substituted by the following : „by Sections 5, 6 ana 7 of Article IV of General Order No. 63, dated 13 July 1946 and by Article VIII of Order No. 349 dated 26 April 1947“. Section 6. — The words : “by Legislative Decree of the Provisional Head of State of 4 April 194 7, No. 207,“ and „in Article 2, letter a) and in Article 8, first para, of the President’s Legislative Decree of 27 June 1946, No. 19“ and decreto No. 207, as contained in Article 7 of the Decree, are hereby deleted and shall be substituted by the following : „by Order No. 396 dated 11 June 1947“ and respectively : „in Article II, Section 1, letter a) and in Article V, Section 1, and in Article VIII, Sections 1 and 2 of Order No. 217 dated 20 September 1946 and Order No. 396.“ Section 7. — The provision as contained under letter j) of Article 8 of the Decree shall be deleted. Section 8. ■— The penultimate paragraph of Article 9 of the Decree shall be deleted and substituted by the following: „in favour of Communes and Provinces may be granted, at the charge of the State budget and for 1947 only, an advance not exceeding four twelfths of the major expenditure, computed for a whole year, deriving from the first application of this Article, which shall be recovered in accordance with the instructions to be fixed by the Allied Military Government, Free Territory of Trieste — Finance Section. The expenditure deriving from the above provisions is included among the ordinary expenses of local Bodies, which may have the right to exceed — subject to the authority of the Allied Military Gpvernment, Free Territory of Trieste, Finance Section — the maximum limits established in respect of taxes and overtaxes, after that of all taxes provided for by existing regulations governing local taxes have been applied at the maximum rate allowed at present“. Section 9. — The words : „of the Legislative Decree of the Provisional Head of State 25 October 1946, No. 263“, contained in the last para .of Article 9 of the Decree shall be deleted and substituted bv the following : „of Order No. 349, dated 26 April 1947.“ Section 10. — The words : “of the Legislative Decree of the Provisional Head of State of 29 December 1946, No. 577“, as contained in Article 10 of the Decree, shall be deleted and substituted by the following : „of Article XIII of Order No. 349 dated 26 April 1947“, and the words : „according to Article 14 of the Lieutenant’s Legislative Decree of 21 November 1945, No. 722“, as contained in the same Article 10 of the Decree shall also be deleted and substituted by the words: „according to Article VIII of General Order No. 63 dated 13 July 1946.“ Section 11. — The words : „the sixth para of Article 2 of the Lieutenant’s Legislative Decree of 21 November 1945, No. 722“, as contained in Article 12 of the Decree are deleted and shall be substituted by the following: „Section 6 of Article II of General Order No. 63 dated 13 July 1946“, and the words : „in the preceding paras“ as contained in the same Article 12 of the Decree, shall also be deleted and substituted by the following : „in Sections 1, 2, 3, 4 and 5.“ Section 12. — The words ,,tho last para of Article 3 of the Lieutenant’s Legislative Decree of 21 November 1945, No. 722, as contained in Article 13 of the „decree“ are deleted and shall be substituted by the following : „Section 10 Article II of General Order No. 63 dated 13 July 1946“. The words „for the purpose of the application of this Article, and the last para of the preceding Article“ are deleted and shali be substituted by the following : „for the purpose of the application of Sections 7, 8, 9 of Article II“. Section 13. — Article 14 of the Decree is hereby deleted. Section 14. ■— The words : „and military“, as contained in the first para of Article 15 of the Decree, and the second para of the same Article are hereby deleted. Section 15. — Article 17 of the Decree is hereby deleted. Section 16. — The second para of Article 18 of the Decree is hereby deleted. Section 17. — Articles 19 and 20 of the Decree are hereby deleted. Section 18. — In amendment of the rules set forth in said Decree with reference to the effective date of the provisions therein contained, it is hereby established that said provisions shall be applied in the Free Territory of Trieste with effect from 15 September 1947. ARTICLE II FINAL PROVISIONS Section 1. — All references to the Italian State and to other bodies, Ministers, or officials acting under its authority, contained in the Legislative Decree of the Provisional Head of State 4 April 1947, No. 207, shall be considered as not existing and shall be substituted by the words : „Allied Military Government and officials or bodies operating in the Zone under the control of Allied Military Government“ ; and nothing which is contained in such Decree may vest any authority on thè Italian State, person or body operating under its authority, either with regard to persons or matters existing in the Zone. Section 2. — A copy of the legislative Decree of the Provisional Head of the State, 4 April 1947, No. 207, has been deposited at the Intendenze di Finanza, and at the Area President’s Office, and may be freely examined by all persons interested. ARTICLE III EFFECTIVE DATE This Older shall become effective on the date it is signed by me. Dated at TRIESTE, this 7th day of January 1947. RIDGELY GAITHER Brigadier General, U. S. Army Senior Civil Affairs Officer Order No. 112 SPECIAL IDENTITY CARD FOR GOVERNMENTAL AGENTS WHEREAS, it is considered necessary to require persons who represent in an official capacity, Governments other than that of Allied Military Government, to be identified ; and WHEREAS, it is considered necessary to issue a special card for such purpose, in that part of the Free Territory of Trieste occupied, by the British- United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army, Senior Civil Affairs Officer, A special identity card as provided herein shall, subject to approval by Allied Military Government, be issued upon request to all persons in the Zone who represent their Governments in an official capacity, provided however the provisions herein shall not be applicable to Allied Military Government or agencies operating under its supervision. ARTICLE II The special identity card shall be issued in English and shall have an Italian and Slovene translation. Army Senior Civil Affairs Officer Order No. 113 EXTENSION OF CONSUMER TAX COLLECTORS CONTRACTS WHEREAS it is deemed necessary to provide for the temporary extension of consumer tax collectors contracts, in that of the Free Territory of Trieste occupied by the British- United States Forces (hereinafter referred to as the „Zone“) NOW THEREFORE I, RIDGELY GAITHER, Brigadier General U. Army, Senior Civil Affairs Officer • ORDER: ARTICLE I EXSTENSION OF COLLECTORS CONTRACTS The existing contracts concerning the collection of Consumer Tax shall be extended to 31 March 1948 except for the Commune of Trieste.
