Although the statutory and regulatory frameworks are similar, relevant case law - particularly of the Constitutional Court, the European Court of Human Rights, and the Court of Justice of the European Union - has largely developed around police powers. Increasingly, these courts also address the powers of other state authorities that interfere with privacy protected by the Constitution, international treaties, and EU law. Given the distinct legal frameworks governing those powers, various constitutional questions arise, including the admissibility of evidence in criminal proceedings. This article critically examines several Constitutional Court decisions on FURS’s privacy-intrusive uses through the use of modern information technology: Decision U-I-33/23 of 16 May 2024 concerning the use of GPS tracking for financial-investigation purposes; and Decision U-I-11/20, Up85/20 of 3 October 2024 on whether online space can be equated with physical space. The article concludes by assessing the admissibility of transferring evidence from non-criminal to criminal proceedings</dc:description><dc:description xml:lang="sl">Nekatera pooblastila, značilna za policijo v kazenskem postopku, imajo tudi organi v nekazenskih postopkih (na primer Finančna uprava Republike Slovenije - FURS). Opaziti je mogoče podobno zakonsko in podzakonsko ureditev, vendar pa je redna sodna praksa in sodna praksa Ustavnega sodišča, Evropskega sodišča za človekove pravice ter Sodišča EU praviloma in večinoma zgrajena na presoji policijskih pooblastil. Postopoma se ta sodišča soočajo tudi s pooblastili drugih (državnih) organov, ki posegajo v zasebnost, varovano na ustavni ravni, z mednarodnimi pogodbami ter s pravom EU. Ob praviloma različnih zakonskih ureditvah teh pooblastil se odpirajo različna ustavnopravna vprašanja, med drugim v zvezi z uvozom dokazov v kazenski postopek in s pravom EU. Prispevek kritično predstavlja nekaj odločb Ustavnega sodišča, ki zadevajo pooblastila FURS, ki pomenijo poseg v zasebnost z uporabo sodobne informacijske tehnologije; odločbo U-I-217/19 z dne 1. junija 2023 o odvetniški zasebnosti v davčnem postopku, U-I-33/23 z dne 16. maja 2024 o uporabi GPS-sledenja za namene finančne preiskave ter U-I-11/20, Up-85/20 z dne 3. oktobra 2024 o tem, ali je mogoče potegniti enačaj med spletnim in fizičnim prostorom.
