Criminal law and criminological aspects illuminating such topic are indicated. A question on consent to the sexual practices (or of the consentaneous sexual practices) is discussed. Special attention is given to a dilemma, whether rape is by its nature an act being motivated by sex or by violence. In this regard, individual rape groups are analysed. Some difficulties with how hard it is to prove the rape itself (as well as penal-legal implications arised from them)are described. Thereby some \"common\" conceptions of rape acts, rapists, and of women being raped are problematized. Criminological theories of the motives for rape are represented. Finnaly, relations between sexual violence, but also violence over sexuality being a part of a \"normal\" female role, are briefly pointed out"},{"@xml:lang":"sl","#text":"Članek obravnava spolno nasilje, predvsem posilstva. Nakazane so kazenskopravne in kriminološke osvetlitve tovrstne tematike. Obravnavano je vprašanje privolitve v spolne prakse (oz. vprašanje soglasnih spolnih praks). Posebna pozornost je namenjena dilemi, ali je posilstvo po svoji naravi spolno ali nasilno motivirano dejanje. V tej zvezi so razčlenjene posamezne skupine posilstev. Opisane so težave pri dokazovanju posilstev (in njihove kazenskopravne implikacije). Ob tem so problematizirane nekatere \"ljudske\" predstave o posilstvih, posiljevalcih in posiljenkah. Predstavljene so kriminološke teorije o vzrokih posiljevanja.
