Problem that arises in connection with the exclusion of evidence is also the purpose of this contribution. Methods: A descriptive method and a comparison method were used. By analyzing primary and secondary legal sources, we tried to identify the drawbacks of the normative regulation of police powers. Findings: Encroachments on constitutionally protected individual rights must be carefully defined by law and controlled, especially if such actions are carried out by a state repressive body. Such interventions also include the police authority to confiscate objects. A broader perception of the privilege against self-incrimination, which also extends to the area of objects confiscations, has led to the need of adapting police procedures and normative regulation. Research Limitations/Implications: We have limited this contribution to the following concepts, namely the confiscation of objects, which is defined in the Police Tasks and Powers Act, the Criminal Procedure Act, the Minor Offences Act and the procedure for confiscating objects, which is carried out by the police in accordance with the provisions of the State Border Control Act. Practical Implications: The contribution is useful in the sense of improving the awareness of individuals in police procedures in case of confiscation of an object or objects and also for improving the skills for correcting errors in procedures where objects are confiscated. Originality/Value: Due to the development and strengthening of human rights, there is a visible impact on the execution of police procedures related to the confiscation of objects. Consequently, it is also necessary to influence the strengthening of the police professionNamen prispevka: Namen prispevka je predstaviti policijsko pooblastilo zaseg predmetov in rabo pooblastil, ki jih policisti izvajajo ob zasegu predmetov. Pri tem je namen opisati problematiko, ki se pojavlja v povezavi z izločitvijo dokazov. Metode: Uporabljeni sta bili deskriptivna metoda in metoda komparacije. Z analizo primarnih in sekundarnih pravnih virov smo poskušali identificirati pomanjkljivosti normativne ureditve policijskih pooblastil. Ugotovitve: Posegi v ustavno varovane pravice posameznika morajo biti skrbno določljivi z zakonom in nadzorovani, še posebej, če takšne posege izvaja državni represivni organ. Med takšne posege spada tudi policijsko pooblastilo zaseg predmetov. Širše dojemanje privilegija zoper samoobtožbo, ki se razteza tudi na področje zasega predmetov, je privedlo do potreb prilagajanja policijskih postopkov in normativne ureditve. Omejitve/uporabnost raziskave: Omejili smo se na pojma, in sicer zaseg predmetov, ki je opredeljen v Zakonu o nalogah in pooblastilih policije, Zakonu o kazenskem postopku, Zakonu o prekrških, in na postopek zasega predmetov, ki ga policisti izvajajo po določilih Zakona o nadzoru državne meje. Praktična uporabnost: Prispevek je uporaben v smislu izpopolnjevanja zavedanja pravic oseb v policijskih postopkih v primeru zasega predmeta oziroma predmetov in kot izpopolnjevanje stroke za odpravljanje napak v postopkih, kjer se zasegajo predmeti. Izvirnost/pomembnost prispevka: Zaradi razvoja in krepitve človekovih pravic je viden vpliv na izvedbi policijskih postopkov, povezanih z zasegom predmetov.
