This is followed by an analysis of open questions and court rulings related to the core terms of consumer credit agreements. To this end, the principle of determining the hypothetical will of the parties in individual negotiations as a substantive criterion for assessing unfairness is explained. The article does not deal with procedural issues or the consequences of nullity. The article focuses on the regulations of the Consumer Protection Act and largely disregards the classic civil law instruments such as usury or laesio enormis"},{"@xml:lang":"sl","#text":"V prispevku bomo najprej predstavili razvoj pravil o presoji poštenosti splošnih pogodbenih pogojev, ki je privedel do novega Zakona o varstvu potrošnikov (ZVPot-1). V nadaljevanju sledi analiza odprtih problemov in aktualnih primerov v zvezi z glavnim predmetom pogodbe o potrošniškem kreditu. V ta namen bomo med drugim predstavili načelo iskanja hipotetične volje strank v individualnih pogajanjih kot enega od vsebinskih kriterijev za presojo poštenosti. Pisanje se ne ukvarja s procesnimi vidiki presoje poštenosti in prav tako ne s sicer zelo aktualnimi izzivi posledic ničnosti pogodbenega pogoja za nadaljnje razmerje med strankama. Razprava je osredotočena na ureditev po ZVPot-1.
