The author takes the position that criminal and misdemeanour proceedings are so different in their fundamental design that the analogous application of the provisions of the Criminal Procedure Code in misdemeanour proceedings is not appropriate. First, because it leads to procedural situations that cannot be resolved through analogous application; second, because it does not necessarily ensure an adequate level of protection of human rights. Finally, the author proposes that the legislature comprehensively regulate house searches in the Misdemeanour Act"},{"@xml:lang":"sl","#text":"Prispevek na dogmatični in praktični ravni analizira vprašanje ustreznosti smiselne uporabe določb Zakona o kazenskem postopku (ZKP) za hišno preiskavo v prekrškovnem postopku. Avtor zavzame stališče, da sta si kazenski in prekrškovni postopek po svoji izhodiščni zasnovi tako različna, da smiselna uporaba določb ZKP v prekrškovnem postopku ni ustrezna. Prvič zato, ker privede do procesnih situacij, ki jih s smiselno uporabo ni mogoče rešiti, in drugič, ker ne zagotavlja nujno ustrezne ravni varstva človekovih pravic.
