Originally it represented mainly the interests of particular States, yet in recent times it becomes more and more enriched by European sources, the European Convention on Human Rights and the EU law, which include common fundamental values of the European states. On the other hand, the same European sources limit the States in protecting the values which are not shared by the community of the European states. It seems that the role of public policy and thus the public policy exception faces important changes in the European legal environment, from the protection of the partial State interests towards the protection of the common interests of the Member States of the Council of Europe and of the European UnionJavni red v mednarodnem zasebnem pravu je skupek temeljnih vrednot, ki morajo biti varovane tudi v zasebnopravnih razmerjih z mednarodnim elementom. V svojih začetkih predvsem odraz interesov posameznih držav, se v zadnjem času vedno bolj bogati iz evropskih virov, Evropske konvencije o pravu človekovih pravic in prava Evropske unije, ki vsebujejo skupne temeljne vrednote evropskih držav. Hkrati je možnost držav, da v okviru javnega reda varujejo vrednote, ki so lastne le njim samim, ne pa tudi širši skupnosti držav, na podlagi istih evropskih virov vedno bolj omejena.
