An important limitation on the application of the law referred to in the Regulation is the public policy (ordre public) reservation. Article 35 of the Regulation allows the court of a Member State to refuse to apply a particular provision of foreign law determined in accordance with the Regulation if such application is manifestly incompatible with the public policy of the State of the court seised (lex fori). It follows from the linguistic, systematic, and historical method of interpretation that the provisions on the right to a reserved share are, in principle, subject to the public policy reservation of the State in which the proceedings are taking place (lex fori). However, when invoking the public policy reservation, courts must consider certain limitations set out in this article. The following section presents developments in Austria, France, and Germany</dc:description><dc:description xml:lang="sl">Za primere dedovanja z mednarodnim elementom se načeloma uporablja Uredba 650/2012 o dedovanju. Pomembna omejitev uporabe prava, na katerega napoti Uredba, je pridržek javnega reda (fr. ordre public). Uredba v 35. členu sodišču države članice omogoča, da zavrne uporabo posamezne določbe tujega prava, ki se določi v skladu z ureditvijo v Uredbi, če je taka uporaba očitno nezdružljiva z javnim redom države sodišča, pred katerim teče postopek (lex fori). Iz jezikovne, sistematične in zgodovinske metode razlage sledi, da so predpisi o pravici do nujnega deleža načeloma predmet pridržka javnega reda države, v kateri teče postopek (lex fori). Vendar morajo sodišča pri sklicevanju na pridržek javnega reda upoštevati nekatere v prispevku navedene omejitve.
