Trieste - 1947 Allied Military Government VENEZIA GIULIA General Order No. 104 (26 A) PRICE CONTROL OF NON ESSENTIAL COMMODITIES AND OTHER PROVISIONS CONCERNING PRICE CONTROL WHEREAS by General Order No. 26 provisions have been issued as to the price control of certain essential commodities and services: and WHEREAS, in view of the excessive prices of the free market goods and in view of the refusal of certain shopkeepers to sell goods on request to the public, it is deemed necessary to safeguard the consumers' interests in respect of goods for which no ceiling price has been heretofore fixed, NOW,- THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I AUTHORITY TO THE PRICE FIXING COMMISSIONS TO FIX PRICES (a) Authority is given to the Price Fixing Commissions to fix maximum wholesale and retail prices for clothing and, furnishings not included in Article I of General Order No. 26. Such prices shall be fixed as provided for in General Order No. 26, and after having heard — whenever necessary — the opinion and views of the commercial associations, undertakings and firms concerned. (b) No prices in excess of those established shall be asked, offered, paid or received either diiectly or indirectly or in any manner or by any means whatever. ARTICLE II DEFINITION OF „CLOTHING“ AND „FURNISHINGS“ (a) The terms „clothing“ and „furnishings “shall inter alia include: cotton, woolen, silk and mixed goods, socks and stockings knitted garments ladies’ and gents’ underclothing ; ladies’, gentlemen’s and children’s hats and caps ; threads, embroidery articles ; ribbons ; gloves, suitcases, umbrellas ; parchment, wax and rubber clothing ; babies clothing and cradle articles ; furs both ready made and pieces ; laces, veils and embroideries ; carpets and furnishing cloth : toys and perfumes and other similar clothing and furnishings. (b) Works of art are not subject to the provisions of this Order. ARTICLE III COMMERCIAL OPERATOR’S RIGHTS AND DUTIES (a) Commercial operators are entitled to derive affair margin of profit within the limits of equity and in relation to the real cost of the goods, and the present economic state of the consumers. II, No. 20 - 1 July 1947 703 (b) Authority is given to the Price Fixing Commission to fix from time to time the maximum percentages of profit permitted upon all items subject to the control of the Price Fixing Commission either by General Order 26 or by the terms of this Order. These maximum percentages shall, after approval by the Allied Military Government, be published in an Offi.ial Notice in the Allied Military Government Gazette and will be displayed on the Notice Board of the Price Territorial Office. Copy of this Official Notice shall also be sent to : 1. Area Presidents 2. Communes 3. Chambers of Commerce and Industry 4. Commercial Associations and Trade Unions. . 5. Commercial bodies, on request. ARTICLE IV COMMERCIAL OPERATORS Commercial operators are those who hold a commercial license or are registered with the Chamber of Commerce and Industry. ARTICLE V COMPLAINTS AND PENALTY Complaints against the charging of unlawful prices for commodities specified in thi3 Order and General Order No. 26 as well as complaints of refusing to sell any article or commodity specified in this Order or General Order No. 26 existing or known to exist in any shop, stores or any other commercial operators’ premises, shall be lodged with the Price Enforcement Commission. The Price Enforcement Commission may after investigation, charge the offenders with a violation of the provisions of this Article before an Allied Military Court which Court may, upon conviction, punish the offender by fine or imprisonment or both as the Court shall determine. ARTICLE VI EFFECTIVE DATE This Order shall take effect upon the date of its publication in the Allied Military Government Gazette. Dated at Trieste, this 10th day of June 1947 ALFRED C. Gazette - Vol. II, No. 20 ■ 1 July 1947 General Order No. 105 (57 B) AMENDMENTS TO THE LAWS RELATING TO LOCAL FINANCE WHEREAS it :s deemed essential to make certain alterations to the law relating to local Finance in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the «Territory ») NOW, THEREFOREI, JAMES J. CARNES, Colonel, Inf, Senior Civil Affairs Officer, ORDER : ARTICLE I REPEAL OF SECTIONS 4 AND 5 OF ARTICLE I OF GENERAL ORDER No. S7 Sections 4 and 5 of Article I of General Order No. 57 are hereby repealed. ARTICLE II TAX ON RENTAL VALUE OF NON.RESIDENTIAL PREMISES SECTION 1 — Communes are hereby authorized to levy at their discretion, the tax on rental value on non-residential premises. SECTION 2 — (a) If the tax referred to in Sect. 1 of this Article is applied, the rate of tax shall be 10% of the rental value of the premises as determined in accordance with the provisions of Article I of General Order No. 57. (b) The tax shall be paid for the period of occupancy, any portion less than a month being treated as one month. (c) The provisions of. Article 110 sester and of Section XIX of Consolidated Text on Local Finance, RDL. 14 September 1931, No. 1175, shall apply for the assessment and collection and for the settlement of any disputes arising therefrom. SECTION 3 ■— The following shall be exempt from the tax on rental value: a) untenanted premises; b) premises subject to tax on police-licended premises; c) welfare and charity institutions; d) premises occupied by the State, Provincial and Communal offices and service, by communal concerns («aziende municipalizzate») and by the Chambers of Commerce, Industry and Agriculture; e) public hospitals and public schools; military police and fire-brigade barracks; barracks occupied by any other armed force of the State or Commune; f) premises publicly used for religious purposes, including administrative offices thereof. ARTICLE III AMENDMENT TO GENERAL ORDER 36 AND TO SECTION 2 OF ARTICLE 30 OF CONSOLIDATED TEXT ON LOCAL FINANCE SECTION 1 — The description of «Wines in Bottle» contained in the Consumer Tax Tariff set out in Schedule «A» of General Order No. 36, is hereby amended to read as follows: «These are defined as being in bottles hermetically closed and bearing by means of a label or embossed on the glass an indication of the A.M.G. Gazette - Vol. II, No. 20 - 1 July 1947 705 quality of the wine or the name of the manufacturing firm and include wines of whatever quality also if bottled in the said manner in the premises destined for sale. SECTION 2 —• (a) To the above Consumer Tax Tariff the f ollowing item shall be added under the heading «.Drinks»: «Wines in flasks..................Xi. 25.— per flasks». (b) The rules concerning «Wines in Bottle» shall be applied in determining the tax and for the size of the bottle. SECTION 3 —• Section 2 of Article 30 of Consolidated Text on Local Finance is hereby repealed and the following is substituted in lieu thereof; «Wine destined for the exclusive consumption of the producer who is «taking part manually in the growing, if the wine is consumed in the «place where the grapes are produced and vintaged or under the con-editions established in the regulation. «The exemption shall be one litre per day for the grower and each «member of his family». SECTION 4 — (a) For the purpose of assessing consumer tax on wines, producers shall declare the quantities produced, to the Consumer Tax Office of the Commune where the wine is produced. Quantities for wich the tax has been paid or on which it is not due shall be deducted . therefrom. (b) Premises where vinous drinks are made shall be subject to control in terms of Articles 213 of RD 30 April 1936, No. 1138. (c) Communes may establish regulations for the application of the foregoing provisions by deliberation (deliberazione). ARTICLE IV SPECIAL PROVISIONS RELATING TO VENEZIA GIULIA POLICE FORCE Wine and foodstuffs destined to the Venezia Giulia Police Force shall exempt from Consumer Tax subject to the provisions of Art. 31 of Testo Unico. ARTICLE V AMENDMENT TO GENERAL ORDER No. 82, ARTICLE II SECTION 2 Section 2 of Article II of General Order No. 82 is hereby amended to read as follows: «The reduction of Consumer Tax on pigs for family consumption is «limited to one pig per family per year only to breeders who are man-«ually concerned with the breeding». ARTICLE VI REPEAL TO ARTICLE 44 OF THE CONSOLIDATED TEXT With effect from 1 January -1948, Article 44 of the Consolidated Text on Local Finance RDL 14 September 1931, No. 1175 and the Ministry Decree 21 December 1931, No.' 17427 concerning the compulsory payment by fixed instalment of the tax on 1 confectionery and chocolate, fine soaps, perfumery and furs are hereby repealed» ! 706 A.M.G. Gazette - Vol. II, No. 20 • 1 July 1947 ARTICLE XIII REPEAL OF ARTICLE 183 TO 191 OF CONSOLIDATED TEXT ON LOCAL FINANCE SECTION 1 —■ Articles 183 to 191 of Consolidated Text on local Finance are repealed. SECTION 2 — Municipalities in the Territory are hereby authorized to levy a tax on police-licensed premises, (i. e. premises licensed to sell coffee, food, drinks etc.). SECTION 3 — The tax shall he collected annually on the rental value of the police-licensed premises. SECTION 4 — (a) For hotels, boarding-houses, restaurants, publicrhouses, cafes, bars, and other premises where wine, beer, liqueurs ad any other alcoholic drinks are consumed or sold by retail, the taxable amount shall be ten times the rental value calculated on the basis of rents in force prior to 24 May 1946 the effective date of General Order No. 57. (b) For other premises the taxable amount shall be determined in accordance with general regulations. (c) The increase provided for in the 1 para of this Section shall only refer to rooms where wines and alcoholic drinks are consumed. Any other room shall be taxed according to their actual rental value. SECTION 5 — The tax shall be applied at the following rates: For premises specified in the first para of Section 4; not less than 20 and not more than 30 per cent; for other premises: not more than 10 per cent. SECTION 6 — The provisions of the Consolidated Text on Local Finance shall apply for the assessment and collection of the tax as well as for the sottlement of disputes arising therefrom. ARTICLE XIV REPEAL OF ARTICLE XYI OF GENERAL ORDER No. 87 SECTION 1 •— Article XVI of General Order No. 57 is hereby repealed. SECTION 2 — (a) In applying the «imposta di soggiomo e cura» the hotels, boardinghouses, inns and sanatoriums are classified in the following six categories: A, B, C, L, E and F. (b) The tax due for each person and day shall be as follows: (c) Where the tax has been paid for 30 consecutive days no tax shall be chargeable for the following 90 days. (d) Villas, flats, furnished rooms and other lodgings are divided into four categories. The tax payable for the duration of the stay not exceeding 120 days from the date of arrival in fixed at Lire 1.200.—■ for the first category, Lire 800.— for the second category, Lire 300.— for the third category and Lire 100.— for the fourth category, for each person. SECTION 3 — Keepers of boarding-houses violating the provisions of Article 9 and 12 of RI)L 24 Novembre 1938, No. 1926, converted into Law 2 June 1939, No. 739, shall be liable upon conviction before a Court, to a fine of from lire 500.— to Lire 10.000.—. ARTICLE XVI COMMUNAL COMMISSION AMENDMENT TO ARTICLE XXIY OF GENERAL ORDER No. 57 Articles XXIV of General Order No. 57 is amended to read as follows : «The number of the members of the Communal Commission for appeals «shall be : «For Trieste 9 members «For Gorizia and Monfalcone 7 members «For other Communes 5 members ARTICLE XVII SUPPLEMENTARY ASSESSMENTS The Communes in the Territory, are authorized to make supplementary assessments for the tax on rental value for the year 1947 in consequence of the increases in rent; provided for in General Order No. 64. 710 A,M.G. Gazette - Vol. II, No. 20-1 July 1947 ASTICINE xym EFFECTIVE DATE OF THE PROVISIONS OF THIS ORDER The provisions of Article I, II, VIII to XIII and XV shall become effective as from 1 July 1947. All other provisions of this General Order shall have effect from the date of its pubblication in the Allied Military Government Gazette. Dated at TRIESTE, this 25 day of June 1947. JAMES J. Senior Civil Affairs Officer General Order No. 106 (16 A) EXTENSION OF LEGAL AND CONTRACTUAL TIME LIMITS WHEREAS General Order No. 16, which provided for the suspension of the running of legal and contractual time limits 'and for the extension of other time limits in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory1'’) became effective only on the date it was signed, i. e. on September 26, 1945 : and WHEREAS it is deemed advisable to extend the effectiveness of the provisions therein contained also to the period preceding such date, namely as from April 20, 1945, when as a consequence of acts of war it became difficult and sometimes impossible to safeguard one’’ s proper rights in due time ; NOW THEREFORE I ALFRED C. BOWMAN Colonel J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I ANTEDATING OF GENERAL ORDER No. 16 Article V of General Order No. 16 is hereby repealed and in lieu thereof shall be substituted : „This Order shall become operative on the date it is signed by me and the provisions therein contained shall have effect as from April 20, 1945.“ ARTICLE II EXCEPTIONAL REVIEW OF DECISIONS Judicial or administrative decisions, having, prior to the effective date of this Order, declared the expiration or prescription of time limits provided for by Article I of General Order No. 16, because the said time limits have fallen due between April 20 and September 26, 1945, may be reviewed for the purpose of applying to such decisions the provisions of this Order, upon application of the party concerned. Such application shall be submitted to the same authority, which made the aforesaid decisions, within sixty days from the effective date AiM.G. Gazette i Vol. II, Nò. 20^ July 1947 . 711 of this Order. All parties concerned with the decision to be reviewed shall be made parties to the action and shall be given notice of the time and place of the hearing and be given an opportunity to be heard by the authority reviewing the ease. ARTICLE III EFFECTIVE DATE This Order shall take effect on the tenth day after the date of its publication in the Allied Military Government Gazette. Dated at Trieste, this 20th day of June 1947. Senior Civil Affairs Officer General Order No. Ill (61 G) COLLECTION OF CEREALS — PROVISIONS FOR THE YEAR 1947 WHEREAS, under prevailing conditions it is essential that farmers together with all other citizens, should undertake their full responsibilities in the provision of vital supplies for the population of those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED G. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I > APPLICATION OF GENERAL ORDER No. 61 AND OF SUBSEQUENT AMENDMENTS All provisions contained in General Order No. 61, dated 17 June 1946, shall remain in force as regards the collection of cereals harvested by any person during 1947 insofar as they are not amended by the provisions and additions set forth in the following Articles. General Orders 61 B, 61 C, 61 D and 61 E are hereby repealed. ARTICLE II AMENDMENT OF ARTICLE II OF GENERAL ORDER No. 61 Section 1. — Section 1 of Article II, General Order 61, shall be amended in the sense that all managers of farming enterprises shall be obliged to declare, besides the cereal cultivation, the whole cultivation plan of tho year fixed for the farms or establishments managed by them. Section 2. — Section 2 of Article II, General Order No. 61, shall be cancelled and the following substituted: „All declarations shall be made on or before 23 June 1947. Failure to make the declaration shall an offence “ 712 A.M.G. Gazette - Vol. 11, No. 20 - 1 July 1917 ARTICLE III ADDITION OF ARTICLE IIA TO GENERAL ORDER No. 61 There shall be inserted after Article II of General Order No. 61 the following: „ARTICLE IIA Section 1. — Anyone intending to thresh cereals in the Territory will previously obtain a license to be issued by the appropriate Area Inspectorate of Agriculture. The methods of application and of the granting of said licenses will be published by the said Inspectorate. Section 2. — Any person engaged in the threshing of cereals shall be prohibited from threshing cereals of producers who bring cereals for threshing without a receipt issued by the appropriate Communal Office of the Inspectorate of Agriculture (U.C.S.E.A.) certifying to the filing of the respective declaration. Section 3. — Licencees engaged in threshing shall be obliged : a) to provide for certificates of declaration relating to threshed cereals from the register office of „U.C.S.E.A.“; b) to control the weight of the cereals obtained from the threshing by each producer ; c) to compile on the basis of the ascertained weight the certificate of declaration in three copies, one of which shall be given to the producer and one forwarded to the „U.C. S.E.A.“. The original shall be kept by the licensee for the purpose of eventual control. After the period of threshing the original copies shall be delivered to the appropriate „U.C.S.E.A.“ ARTICLE IV AMENDMENTS TO ARTICLE IV, GENERAL ORDER No. 61 Section 1. — The provisions of para f) of Section No. 1, Article IV, General Order No. 61, shall be substituted by the following : „Share-tenants, fixed salary employees, „semifissi“, „obbligati“ and labourers on cereal farms whose contracts specify compensation in kind, for themselves and each dependant member of their family, up to 2.40 qls per person, in accordance with the methods provided for by the respective labour contract in force on the effective date of this Order“. Section 2. — The provision set forth under letter g) of Section 1, Article IV, General Order No. 61, are hereby cancelled. The provisions set forth under letter h) of No. 1, Article IV, General Order No. 61, shall be marked with letter g) instead of h). Section 3. — The provisions set forth in Section 3 of Article IV, General Order No. 61, are hereby cancelled. Section 4. — The words „1.60 qls.“ relating to corn for production as forage under Section 4 of Article IV, General Order No. 61, are hereby substituted by the words „2 qls“. A.M.G. Gazette - Vol. II, No. 20 ■ 1 July 1947 713 Section 5. — The words „4 qls.“ of com for adult hogs to be stable fattened set forth under No. 5 of Article IV, General Order No. 61, shall be substituted by the words „3 qls.“ Section 6. — The following provision shall be added to Article IV, General Order No. 61 : „7. — Limits of self-sufficiency. The limit of self-sufficiency as to the provisioning with grain for those entitled to retain grain for their families is hereby established at 1.80 qls. „pro capite“ for the categories entitled to retention of a maximum of 2.40 qls. per person, and 1.50 qls. ,,pro-capite“ for the categories entitled to retention of a maximum of 1.80 qls.
