Trieste - 1947 Allied Military Government VENEZIA GIULIA General Order No. 92 (25 D) PROVISIONS RELATING TO DIRECT TAXES WHEREAS it is considered advisable to issue various provisions relating to Direct Taxes and to amend certain provisions of General Order No. 25, 25 B and Order No. 114, in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: PART „A“ ORDINARY TAX ON PROPERTY ARTICLE I The value of the reai property, live-stock and implements, and the value of industrial and commercial concerns, ' for the years 1947-1948-1949, for the purpose of the ordinary tax on property (imposta ordinaria sul patrimonio) shall be multiplied by ten except for the value of buildings „fabbricati“ which shall be multiplied by five. The 1946 tax rolls shall be used as the basis for this computation. ARTICLE II Section I. — The tax shall be registered by the Direct Tax Office without notification to tax-payers, on the basis of the value established in terms of the foregoing Article. Section 2. — The Finance Administration may order and the tax-layers may ask for a revision with effect from 1 January 1947 of the values of real property resulting from the application of the coefficients referred to, in Art. I hereof, on the basis of the commercial value prevailing on the first January 1946. Section 3. — Such revision shall be made as concerns live-stock and implements, on the basis of commercial prices prevailing on contracts concluded on dates nearest to the 1st of January 1946 ; and in the case of industrial or commercial concerns, in accordance with the provisions of R.D.L. 12 October 1939, No. 1529 converted into the Law 8 February 1940, No. 100. Section 4. — The right to order a revision may be exercised by the Finance Administration on or before the 31st of December 1947 and may be requested by the tax-payers within three months of the publication of the rolls. ARTICLE III If the valuation of the real property has not been made on the basis of the average commercial value for the years 1937 - 1938 - 1939, District Direct Tax Offices shall, on or before 31 December 1947. order such valuation and apply thereto the coefficients established in Art. I hereof, or shall initiate the revision in terms of the Section 2 of the preceding Article ; the new assessment shall be effective as from the 1st of January of the said year.- The Finance Administration may provisionally increase the taxable values (valori pa-trimoniali) of the real property referred to in Section 1, for the purpose of their entry into the rolls for 1947, as registered in the 1946 rolls by applying the coefficients established by Art. I hereof, until the final assessment has been adjusted. 457 ARTICLE IV The ordinary tax on property (imposta ordinaria sul patrimonio) as from 1947 shall be levied at the rate of 0.40 percent. Properties (cespiti patrimoniali) which do not exceed lire 100.000.— shall be tax free. PART ,,B“ TAX ON LANDS (TERRENI) AND AGRICULTURAL LAND INCOME (REDDITO AGRARIO) ARTICLE V Section 1, Article II, Order No. 114, dated 11 April 1946, is hereby revoked and in lieu thereof shall be substituted : „SECTION 1 — With effect from 1 January 1947, taxable income from „terreni“ and „reddito agrario“ liable to taxation under R.D.L. 4 April 1939, No., 589, converted into Law No. 976-of 29 June 1939, shall be increased 6 times“. ARTICLE VI Section I. — If, owing to war damage, the yield of the lands has been reduced by at least one third of the ordinary yield, the Finance Administration may grant a temporary reduction of taxes and surtaxes on „terreni“ and „reddito agrario“. Section 2. — Such reduction for lands included in the communal territory or in a communal Zone shall be grant by Allied Military Government through the Intendenza di Findnza before the application of the President of Commune. Section 3. — The reduction regarding single land-holdings, shall be granted by the Intendenza di Finanza, upon application of the owner. The Intendente may suspend the collection wholly or partially, pending the request for the reduction. The application and the supporting evidence, shall be stamp duty free. Section 4. — If the decrees in yield as finally assessed is less than 15% of the ordinary produce, the applicant shall be liable for the payment of the survey expenses incurred which will be recovered in accordance with the procedure established for the collection of direct taxes. Section 5. — If the revision as provided for by Art. 13 of R.D.L. 4 April 1939, No. 589, converted into Law 29 June 1939, No. 976, has become necessary owing to changes in the yield consequent to the war action, the revision may be made prior to the time limit established by the said article. Such revision may be sought also by the President of the Commune. PART „0“ TAX ON BUILDINGS (FABBRICATI) ARTICLE VII Section 1. —• The taxable income from buildings „fabbricati“ liable to taxation in 1947 tax rolls is hereby doubled without notification to tax-payers. The Finance Administration may partially revise such taxable income under the normal procedure as provided by the Law. Section 2. — The tax-payer may, within three months from the publication of the tax rolls, ask for rectification, with effect as for 1948, by producing evidence that the taxable income as registered in the tax rolls exceeds the real or potential income. PART ,,D“ REVISION OF INCOMES UNDER CATEGORY ,,B“ AND „C/1“ AND THOSE LIABLE TO INCOME SUPERTAX ARTICLE VIII The time limit of 31 December 1946, fixed by Art. I of General Order No. 25 13. dated 30 April 1946, for the special revision of Category „13“ income not taxed on the basis of the balance-sheet and of Category ,,C/1“ incomes, is hereby extended to 30 June 1947. 458 ARTICLE IX The time limit of 31 December 1946 established in Art. 21 of General Order No. 26, dated 29 November 1945, for the special revision of incomes which are liable to supertax, is hereby extended to 31 December 1947. Incomes which do not exceed the minimum fixed by Art. I of General Order No. 25 C, dated October 8, 1946, will continue to be inscribed in the roll until such time as the revision in terms of this Article has been completed, applying to such incomes the rate of 2% pending assessment. ARTICLE X This Order shall become effective on the day it is signed by me. Dated at TRIESTE, this 21st day of February 1947 ALFRED C. BOWMAN Colonel, J.A. G.D. Senior Civil Affairs Officer General Order No. 95 (41F) SPECIAL COURT OF ASSIZE WHEREAS, by Proclamation No. 5 the Special Court of Assize ivas constituted for the purpose therein proclaimed, for a period of six months expiring on. the 8th day of February 1946 ; and WHEREAS, by General Order No. 41, dated the 25th day of January 1946, General Order No. 41 B, dated the i8th day of April 1946, General Order No. 41 C, dated the 2nd day of August 1946, General Order No. 77 (41 D) dated the 17th day of October 1946 and by General Order No. 94 (41 E) dated the 8th day of February 1947, the Special Court of Assize as constituted by proclamation No. 5 has been continued for further periods expiring on 31st March 1947, and WHEREAS, it is deemed necessary to provide for the termination of the Special Court of Assize and to make provision for the trial of offences according to the normal rules of procedure, NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, hereby ORDER: ARTICLE I Section 1. — With effect from the date of this Order all cases not set for trial before the Special Court of Assize will be transferred to the ordinary judicial authority for trial in accordance with the normal rules of jurisdiction. Section 2. —- For the purpose of carrying out the trials of offences provided for in Proc. 5 which, according to the normal rules of jurisdiction should be tried before a military Court, authority is hereby given to the Ordinary Court of Assize to try such offences. ARTICLE II j All denunciations, records, evidence and other documents relating to untried cases shall be transferred by the Special Court of Assize to the appropriate Judicial Authority not later than 31 March 1947. ARTICLE III Cases originally adjudicated on by the the Special Court of Assize, which the Special Section of the Court of Appeal functioning as Court of Cassation remit back for partial or complete new trial will, with effect from the date of this Order, be remitted to the Ordinary Court of Assize. . Senior Civil Affairs Officer 459 Order No. 310 (251 A) INCREASE OF THE ANNUAL RATES PAYABLE TO CONTRACTORS PERFORMING THE POSTAL TRANSPORT SERVICES WHEREAS it is deemed desirable and necessary to increase the rates payable under Order No. 251 to the automobile enterprises performing public services for carrying mail within that part of Venezia Giulia administered by the Allied Military Government (hereinafter referred to as the ,, Territory'') NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I INCREASE OF THE ANNUAL RATES PAYABLE UNDER ARTICLE I OF ORDER N. 251 Section I. — The annual rates payable under Article I, Subdivision (a) of Order N. 251 for mail transport, shall be 900 Lire for every Kilometer of line covered for transport; the compensation of 50 Lire for every intermediate Postal Office actually served, shall be considered included in the said rates. Section 2. — Whenever the Post & Telegraph Administration (Direziqne Superiore delle Poste e delle Telecomunicazioni) of Trieste deems advisable to use for such mail transport a stretch of the line, not exceeding 15. Kilometers, on which more than two double jom-neys are effected daily, annual rate for every Kilometer shall be 1.800 Lire. ARTICLE II This Order shall take effect as and from 1st July 1946. Senior Civil Affairs Officer Order No. 316 MARRIAGE OF MEMBERS OF THE UNITED STATES ARMED FORCES PERFORMED BY ARMY CHAPLAINS WHEREAS it is considered necessary to make provision for the legalization of marriages performed by United States Army chaplains, between members of U.S. Armed Forces and Italian nationals or foreigners in that part if Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C, BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer ORDER: ARTICLE I LEGALIZATION OF MARRIAGES PERFORMED BY ARMY CHAPLAINS Section i. — For the purpose of contracting marriages in the Territory between members of the U. S. Armed Forces and persons subject to military jurisdiction and Italian citizens or foreigners residing in the Territory, catholic chaplains of said Forces shall be considered cathol- 460 io priests (ministri del culto cattolieo) in accordance with the provisions o f the Law dated 27 May 1929, No. 847, and non-catholic chaplains shall be considered ministers of religions recognized by the State (ministri dei eulti ammessi nello Stato), appointed and approved in accordance with the provisions of Article 3 of the Law dated 24 June 1929, No.. 1159. Section 2. —-A marriage celebrated before said chaplains shall have the full legal effect from the date of the marriage when transcribed in the „Stato Civile“ of the Territory in accordance with the provisions set forth in the following articles. ARTICLE II REGISTRATION OF MARRIAGE CERTIFICATE Section X. — If both contracting parties to the marriage are foreigners, the Commanding Officer of one of the parties, shall, within 30 days after the marriage has been qelebrated, request its registration to the official of the „Stato Civile“ in the Commune where the marriage was celebrated. Section 2. — With this request the following must be supplied : a) Marriage certificate signed and verified by said Officer, Said certificate must disclose the following information : x) First name, last name, age, profession, place of birth, citizenship, name of the state, domicile or residence of the parties ; 2) First name and last name, domicils and residence of their parents ; 3) Place and date of the marriage ; 4) First name and last name of the chaplain before whom marriage was celebrated. b) Translation of the marriage certificate in Italian, verified by the same officer ; c) An original statement in Italian or an Italian translation of the original, verified as provided in Section 2, Subdivision b) of this Article. It must appear that there are no impediments to the marriage according the law of the domicile of both contracting parties and it must also appear that there are no impediments under the provisions of the Italian Law, Articles 85, 86, 87, Subdivision 1, 2 and 4 arid Articles 88 and 89 of the Civil Code. Section 3. —— The statement as provided under Section 2, Subdivision e) of the preceding paragraph shall be issued by the Commanding General Mediterranean Theater of operations United States (MTOUSA) or his duly authorized officer not only for personnel accompanying the U.S. Armed Forces but also for personnel in the service of said Armed Forces or employed by the U. S. Government. Such statement shall contain information set forth under Section 2, Subdivision 1. and 2. of the preceding paragraph. Section 4. — If the marriage is celebrated before a catholic priest (ministro del culto cattolieo, ),.the official of the „ Stato Civile of the Territory after noting the legality of said request, shall immediately provide for its registration in accordance with the provisions of Articles 9 and 12 of the Law dated 27 May 1929, No. 847, except that Article 14 of said Law shall be applied if said request has been filed after the term prescribed in Section 1 of this Article. Section 5. — If the marriage has been celebrated before a non-catholic minister of a religion recognized by the State (ministro di un culto ammesso nello Stato), the official of the „Stato Civile“, of the Territory after noting the legality of said request, shall immediately provide for its registration, however, considering the provisions of Article 10 of the Law dated 24 June 1929, No. 1159. Section 6. — If the request appears not to be proper, the official of the „Stato Civile“ shall postpone its registration and shall inform the Allied Military Government who shall inform the Allied Military Government who shall give instructions as to the decision of the case. ARTICLE III PROCEDURE FOR MARRIAGE CELEBRATION AND REGISTRATION Section 1. — If one the contracting parties is an Italian citizen, celebration of the marriage must be preceded by publishing the barms in the place, of residence of the party having Italian citizenship in accordance with the provisions of Article 93 and the following Articles of the Civil Code. 461 The chaplain before whom the marriage is celebrated must read to them Articles 143, 144 and 145 of the Civil Code. Section 2. — The marriage certificate shall be prepared in Italian immediately after the marriage has taken place in accordance with the provisions of Articles 107 and 108 of the Civil Code and Articles 126, 128 and 129 of the R.D. dated 9 July 1939, No. 1238, concerning regulations of the „Stato Civile“ and the original shall be transmitted within five (5) days after the celebration to the official of the „Stato Civile“ where the publishing of the banns were requested. For the benefit of the party not having Italian citizenship, the marriage certificate must be accompanied by a statement as provided in Section 2, Subdivision c) of Article II. Section 3. — If the marriage was celebrated before a catholic priest (ministro di culto cattolico) registration shall be made in accordance with the provisions of Articles 9, 11, 12, 13, 14 and 15 of the 'Law dated 27 May 1929, No. 847. Section 4. — If the marriage was celebrated before a non-catholic minister of a religion recognized by the State (ministro di an culto ammesso nello Stato), the official of the „Stato Civile“, after noting the legality of the publishing of the banns, the marriage eertificat and the statement as requested under Section 2 of this Article, and after having ascertained that no objections to the banns have been raised, shall immediately provide for registration of the marriage certificate in the „Stato Civile“, so that the information requested under Section 2, Subdivision a) of Article II of this Order shall be apparent. Whenever he finds any irregularity, he shall postpone its registration and shall issue a certificate stating the reasons of postponement. An appeal may be made to the Court (Tribunale) which shall proceed in accordance with the provisions of Article 112 of the Civil Code. ARTICLE IV CIVIL MARRIAGE If the parties mentioned in Article 1 wish to celebrate a marriage before an official of the „Stato Civile“ of the Territory, the statement required under Section 2, Subdivision e) of Article II of this Order shall substitute the statement required by paragraph 1 of Article 116 of the Civil Code. ARTICLE V RETROACTIVE EFFECT All marriages celebrated on or after 12 June 1945 in this Territory, in accordance with the provisions of this Order, shall be considered as valid from the date of the marriage, provided that such marriages are properly registered within three (3) months subsequent to the publication of this Order in the Allied Military Government Gazette. ARTICLE VI EFFECTIVE DATE This Order shall become effective in the Territory on the date of its pubblication in the Allied Military Government Gazette. Senior Civil Affairs Officer 462 Order No. 318 PROVISIONS IN FAVOUR OF COMMUNAL AND AREA TREASURES WHEREAS it is considered necessary that Communes and Area Administrations be authorized to grant an additional compensation for increased treasury service expenses, in those parts of Venezia Giulia administered by Allied Forces (hereinafter referred to as „Territory), NOW, THEREFORE, I, ALFRED C. Senior Civil Affairs Officer, ORDER: ARTICLE I ADDITIONAL COMPENSATIONS Section i. — Communes and Area Administrations are authorized to grant to their treasurers, when they are not tax collectors or area receiving agents of direct taxes, annual additional compensations for the period from 1 July 1945 to 30 June 1947, upon request by such treasurers, when as a consequence of the greater expenses incurred after June 12, 1945 as a result of the increase in wages and other costs, their treasury service has become excessive, in cost. Section 2. — The provisions contained in Section 1 of this Article may also be applied to treasurers who are not tax collecting agents or receiving agents of direct taxes, taking, however, into consideration the benefits granted by Allied Military Government by Orders 34 of 30 October 1945, No. 66 of 5 February 1946 and 211 of 1 October 1946. ARTICLE II APPROVAL FOR GRANTING THE ADDITIONAL COMPENSATIONS The decisions of Communes and Area Administrations for the payments of the compensations referred to in Article I must be approved by the Area Presidents and Allied Military Government as concerns treasurers referred to in Section 1 Article' I and by the Area Presidents, the Intendenze di Finanza and Allied Military’Government in respect of treasurers referred to in Section 2 Article I.
