Editoriale Libraria, Triesfe - 1946 General Order No. 36 CONSUMER TAX WHEREAS, it is deemed desirable and necessary to authorize Communes to impose a Consumer Tax on certain goods and to fix the maximum rates of such Tax within that portion of Venezia-Giulia administered by the Allied Forces (hereinafter referred to as the ,,Territory“) ; NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER ARTICLE I GOODS SUBJECT TO CONSUMER TAX Section' 1. —- Article 20 of Testo Unico per la Finanza Locale, R. D. 14 September 1931, No. 1175, (hereinafter referred to as T.U.N.), which set forth the goods subject to consumer tax, is hereby repealed. Section 2. ■— a) Tne Communes within the Territory are hereby authorized to impose a consumer tax as to all or any of the following : meat, fresh fish ; preserved fish ; milk and cheese products ; butter and butter substitutes ; wine ; cocoa , chocolate ; confectionary ; perfumes and cosmetics ; fine soap ; electric power ; building materials ; furniture ; furs ; and gas. b) In addition, Communes having a population of 40.000 or over, and Communes recognized as health resorts, may impose a Consumer Tax as to poultry, rabbits and venison. Section 3. — The Communes of the Territory, with, the prior approval of the Allied Military Government, are further authorized, if justified by local conditions, to impose a Consumer Tax of not more than 10 percent ad \alorem as to other goods not included in the foregoing Sections, provided that such goods are not subject to manufacturing or consumer taxes imposed by the State. Section 4. — Goods to be exported to foreign countries shall be exempt from Consumer Tax. Section 5. -— The Consumer Tax shall be applied and collected in accordance with the rules and regulations set forth in T.U.N., except as specifically modified by this Order, and in accordance with such local regulations as may exist or as may legally be enacted. ARTICLE II MAXIMUM RATES OF CONSUMER TAX Section 1. -—• The maximum rates of Consumer Tax which may be imposed shall be those set forth in the Tariff attached to and made part of this Order and marked Exhibit ,,A£‘. The maximum rates of such Tax set forth in the Tariff forming part of Article 95 of T.U.N. are hereby modified accordingly. Section 2. *—- The rates of Consumer Tax imposed by Communes, in accordance with this Order, shall become operative and effective upon their approval in writing by the Allied Military Government and the Presidents of the respective Areas of the Territory. Section 3. — a) The rates of tax established for the goods set forth in the Tariff attached to and made part of this Order may not be exceeded. b) The rates of tax on wine, must and grapes, shall be kept proportionate to the rates fixed in the Tariff forming part of Articles 95 and 96 of T.U.N. Section 4. •—- The value of goods as to which the Consumer Tax is to be applied at ad valorem rates shall be fixed on January 1 and July 1 of gach year on the basis of the average prices for the previous quarter. The prices authorized by Communes on the advice of the Price Control Office of Sezione Provinciate deH’Alimentazione (SEPRAL) and the Chamber of .Commerce shall be controlling. Section 5. ■— The Communes imposing the Consumer Tax must not fix a time limit for the application of the rates adopted and such rates may be modified only by the proper Communal authority and within the maximum rates established by this Order. Section 6. •— So far as inconsistent with the above provisions, Article 22 of T.U.N., as modified by R. D. L. 12 April 1943, No. 449, is hereby repealed. Section 7. -—• Upon the imposition of the Consumer Tax in accordance with the Tariff established by this Order, all supplementary and additional fees applied on the basis of the former Consumer Tariff and collected by the State or by any public agencies, other than Communes, shall cease to have effect. ARTICLE III WINES Section 1. — The last two paragraphs of Article 96 of T.U.N., dealing with Consumer Tax on wines, is hereby repealed. Section 2. — a) Sparkling wines in bottles shall be deemed to include champagne . and all other sparkling wines in bottles of tempered glass, resistant to high pressure and of the type known as „champenoise“, and closed with a cork fastened by wire or thread. b) The term „bottle“ shall be taken to mean a glass container of a capacity of half a iter to one liter. c) Tne Consumer Tax on all other wines shall be assessed and collected in the same manner as on sparkling wines. ARTICLE IV POULTRY, RABBITS, VENISON, FISH, BUTTER AND BUTTER SUBSTITUTES AND COCOA Section 1. ■—• Tne Consumer Tax on poultry, rabbits, venison, fresh fish, and butter and butter substitutes, shall be collected in accordance with the provisions contained in the following Articles of T.U.N. : Article 32, paragraph 2 and 3 ; Article 33 to 36 inclusive ; and Article 40, second and third paragraph. Section 2. — The Consumer Tax on cocoa and cocoa substitutes shall be collected in accordance with the provisions of Article 44 of T.U.N. Section 3. ■— A consignment note shall be necessary for the transportation of poultry, rabbits and venison, exceeding 10 kilograms, and butter and its substitutes exceeding 3 kilograms. Such note shall not be necessary for the transportation of fresh fish. Section 4. ■— The following may be brought into Communes from other Communes or from outside the Territory, free from Consumer Tax poultry, rabbits and venison, not exceeding 5 kilograms ; cocoa and cocoa substitutes, not exceeding 1 •% kilograms ; butter and butter substitutes, not exceeding 1 kilogram ; fresh fish and mussels, not exceeding 3 kilograms. ' ARTICLE V SUPPLEMENTARY FEES Section 1. Tne following Laws dealing with supplementary fees are hereby repealed: Article 100 of T.U.N., as amended by paragraph (b) and (c) of the Law of 23 June, No. 901 ; Article 4 of the Law of 21 October, 1940, No. 1504 ; and Article 6 of the Law of 12 April, 1943, No. 449. Section 2. — a) The Communes of the Territory are authorized to charge a statistical fee not exceeding 0.50 lire for each invoice. b) Contractors who collect the Consumer Tax for a fixed amount pursuant to contract or on commission shall receive a commission of 4 percent for the collection of statistical fees. Section 3. •— The Communes shall also be entitled to a fee for examination at the taxpayer’s premises or at any place beyond the Office limits at an hourly rate to be fixed by the Commune in agreement with and within the limits fixed by the Labor Office. ARTICLE VI MATERIALS FOR THE REPAIR OF BUILDINGS Section 1. ■—• a) Subject to the provisions hereinafter stated, materials to be used in the re-building or repair of war damaged buildings shall be exempt from Consumer Tax. Such exemption shall be effective without regard to the time necessary to rebuild or to repair or to the extent of such rebuilding or repair. b) To obtain such exemption, the owner must file with the Commune a written declaration stating the type of the building, its location, the damage, and the extent of the re-building or repair which is contemplated. Such declaration must be supported by a corroboratory certificate from the Genio Civile of the Ufficio Tecnico Erariale. Section 2. -— The'annual contribution required by Article 39 of T.U.N. is hereby suspended as to war damaged or uninhabitable buildings until the re-building or repairs are completed. Section 3. -—• The sixth paragraph of Article 80, T.U.N., so far as inconsistent with the provisions of this Article, is hereby repealed. ARTICLE VII COMMISSIONS Section J. — a) A commission of 4% is hereby granted upon the increased revenue resulting from the application of the Tariff established by this Order as to all contracts for commissions or specific amounts in force upon the effective date of this Order. b) In the event that such percentage increase results in an excessive commission or, notwithstanding such increase, results in a commission insufficient to cover expenses, the Commune and the Collector are hereby authorized*to fix a different rate of commission by mutual agreement. If no agreement can be reached, the Commission shall be fixed in accordance with the applicable provisions of R. D., 23 January, 1931, No. 36. • Section 2. ■—• The revenue collected by Tax Collectors, less commissions, shall be paid to the Commune at the time fixed in the contract for the payment of moneys collected. Section 3. •— The revision of contracts for specific amounts collected by „Consorzi degli esercenti“, shall be made in relation to the presumed increased revenue to be . derived from the application of the Tariff established by this Order, by mutual agreement if possible. In the event that no agreement can be reached, the provisions of R. D. L., 25 January, 1931, No. 36, shall be followed. Until the new charge is fixed by agreement or otherwise, the ,,Con-sorzio degli esercenti“, shall pay to the Communes, pending final settlement and adjustment, double the amount due at present to .the Communes in accordance with the provisions of D. L., 12 April, No. 449. Section 4. ■— The guarantees delivered by Collectors and „Consorzi degli esercenti“, shall be revised in relation to the increased revenue resulting from the application of the Tariff established by this Order. The regulations contained in Articles 81 and 87 of T.U.N., shall remain in force in this regard. Section 5. ■— So far as Inconsistent with this Article, Article 2 of R. L). L., 28 July, 1937, No. 1574, as modified by the Law of 30 December, 1937, No. 2240, and Article 1 of the Law of 21 October, 1940, No. 1504, are hereby repealed. ARTICLE VIII EFFECTIVE DATE OF ORDER This Order shall take effect on the date that it is signed by me. Dated at Trieste, this 16th day of January, 1946. ARTICLE II The jurisdiction of the Court and all its powers and duties specified in Proclamation No.. 5 shall continue in full force and effect as if the Proclamation had constituted the said Court for the said period of 3 months from the 8 February 1946. BOWMAN Colonel, J.A.G.D., Senior Civil Affairs Officer ALLIED MILITARY GOVERNMENT 13 CORPS Order No. 36 SCHOOL OF LETTERS AND PHILOSOPHY, UNIVERSITY OF TRIESTE WHEREAS, the School of Letters and Philosophy has been instituted by the Academic Body of the University of Trieste, and WHEREAS, upon study and consideration, it has been decided that said school be also recognized by the Allied Military Government, now, therefore, I ALFRED G. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer do ORDER: 1. •—- The School of Letters and Philosophy, now existing at the University of Trieste is hereby recognized as to all its intents and purposes by the Allied Military Government of Venezia Giulia, and legal recognition is hereby extended to any degree given by the school of Letters and Philosophy of the University of Trieste ; 2. —• Seven chairs of professorship are hereby created for the school of Letters and Philosophy ; the number of which may be eventually increased as the want of the same are made to appear from time to time. 3. >—- The. internal organization and discipline of the school shall be under the same rules and regulations now in force for the other Schools of the said University. Order No. 63 TEMPORARY DETERMINATION OF STATE PENSIONS AND CONSTITUTION OF PENSION COMMISSIONS THEREFOR WHEREAS it is deemed desiderable and necessary to make provision for the temporary determination of state public pensions within that paft of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory11 ) ; NOW, THEREFORE,!, ALFRED G. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I. PENSION COMMISSIONS Section 1. •—• An Area Pension Commission, consisting of a Chairman and 5 other members, shall be constituted in each Area of the Territory with the duties and functions to be hereinafter stated. ' Section 2. — The Chairman and members of such Commissions shall be appointed and be removable by the Area Commissioners of the respective Areas and shall consist of the following : the President of the Tribunale of the Area or a Magistrate to be by him designate of a grade not lower than Grade 6, who shall act as Chairman ; the Intendente di Finanza of the Area ; the Chief Accountant of the office of .the Intendente di Finanza of the Area ; the Provincial Doctor ; the Director of the Ufficio Provinciale del Tesoro ; and a recognized expert as to military pensions. ARTICLE II. DUTIES AND FUNCTIONS OF AREA PENSION COMMISSIONS Section 1. — The Area Pension Commissions shall determine upon a temporary basis the right to and the amount of public pensions of every nature of the State and of autonomous State Administrations, direct and indirect, temporary and renewable, including allowances in the nature of pensions and privileged allowances, in favor of public workes and employees, civilian and military and war invalids, and their families, survivors and dependents. Section 2. -—■ In performing the above function, the Commissions shall possess all. the powers and be subject to all the duties of Central Administrations of the State and of the Court of Accounts regarding public pensions, in accordance with all Laws applicable thereto which were* in effect on 8 September 1943. ARTICLE III. PROCEDURE Section 1. ■—- The Commissions shall act in all cases upon written applications of claimants to public pension supported by necessary documentary proof, in accordance with all Laws and Regulations which were dn effect on 8 September ,1943. Section 2. ■—- The determinations of the Commissions shall become effective immediately when made without further action. Section 3. —1 a) The Commissions shall immediately give written notice of such determinations to the claimants and the proper Ufficio Provinciale del Tesoro. b) If the application is granted, the Ufficio Provinciale del Tesoro shall open a provisional account, deliver a certificate of temporary inscription to the claimant-by means of the proper Communal President, and begin payments. Section 4. — The decisions of the Commissions shall not be appealable during the administration of the Territory by the Allied Forces. ARTICLE IV. Senior Civil Affairs Officer ALLIED MILITARY GOVERNMENT 13 CORPS Order No. 64 RE-CONSTITUTION OF THE FORESTRY OFFICES WHEREAS, it is deemed desirable anc{ necessary to constitute new Forestry Offices and to define tlieir functions, within that pari 0f Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil A ffairs Officer, hereby as follows : ORDER ARTICLE I CONSTITUTION OF NEW FORESTRY OFFICES The following Forestry Offices are hereby constitued : - A) Territorial Office. This Office shall be called the „Territorial Forestry Office“. . It shall supervise the functions of all Forestry Offices hereinafter mentioned throughout the Territory. B) Area Offices. There shall be one such Office .to be called the „Area Forestry Office“ in each of the Areas in the Territory, i. e. Gorizia, Pola, Trieste. Each such Office shall super vise the functions hereinafter set out of all District Forestry Offices within its Area. Each Area Forestry Office shall be under the supervision of the Territorial Forestry Office hereinbefore constituted. C) District Office. Tne Area of Gorizia and Trieste shall be divided into Forestry Districts, in each of which there shall be an Office, to be called a „District Forestry Office“, as follows: GORIZIA AREA : (Canale) Caporetto, Plezzo, Comeno, Gorizia. TRIESTE AREA: Duino-Aurisina, Muggia-San Dorligo, Sesana, Trieste. Each District Forestry Office shall be under the supervision of the Area Forestry Office of the Area in which such District is situated. The exact Area in which such District Office shall exercise the functions hereinafter assigned to it will be laid down by instructions to be issued by the Allied Military Government. ARTICLE II FUNCTIONS All Forestry Offices hereinbefore constituted in addition to any supervisory or other functions assigned to them by this Order shall administer all property formerly administered by Azienda di Stato per le Foreste Demaniali and shall also perform all other functions in regard to woods, pastures and other property formerly performed by the Forestry Milizia. The said Offices shall also have suoR functions in relation to hunting and fishing as shall be laid down by further Order by the Allied Military Government. io In all their functions the said offices shall be subject to the control and comply with the orders and instructions of the Allied Military Government. ARTICLE III PERSONNEL All personnel employed in carrying out the functions of the Forestry Offices hereinbefore constituted shall be members of the Venezia, Giulia Police Force. The Senior Official of the Territorial Forestry Office' hereinbefore constituted shall be appointed and removable in writing by the Venezia Giulia Police Force with the advice of the Allied Military Government. The Senior Official of each of the Area Forestry Offices hereinbefore constituted shall be appointed by the Venezia Giulia Police Force with the advice of the local Area Commissioner of the Allied Military Government upon nomination by the Senior Official of the Territorial Forestry Office and shall be removable by the Venezia Giulia Police Force with the advice of the Àrea Commissioner. The Senior Official of each District Forestry Office hereinbefore constituted shall be appointed and removable by the Senior Official of the Territorial Forestry Office with the previous approval of the Venezia Giulia Police Force with the advice of the Area Commissioner of the Allied Military Government concerned. Each of the Senior Officials appointed as aforesaid shall be called „the Chief“ of the Office to which he is appointed. All personnel shall be divided into three groups : a) Technical bJ Administrative c) Police With the exeption of the Chiefs hereinbefore mentioned they shall be appointed and removable only by the Chief of the Venezia Giulia Police Force on the advise of the Chief Agri-culttural Officer of the Allied Military Government. They shall be subject in technical matters to the Orders and Instructions of the said Chief Agricultural Officer and in all other matter to the Orders and Instructions of the Chief of the Venezia Giulia Police Force. ARTICLES IV WAGES, EXPENSES AND REVENUE Section 1. — a) Salaries and wages of all the personnel of the above Offices (administrative, technical and police), shall be paid by the Venezia Giulia Police Force. b) All other expenses shall be paid by the Senior Official of the Territorial Office. Section 2. — The necessary funds for the Offices shall be provided by the Chief Finance Officer, Allied Military Government, through budgets to be submitted in accordance with instructions to be hereinafter issued by the Chief Finan ce Officer. Section 3. —■ The revenues to be derived by the said Offices from the administration of State Property shall be disposed of as the Chief Finance Officer of the Allied Military Government shall direct. ARTICLE V AVOIDANCE OF PROVISIONS INCONSISTENT WITH THIS ORDER AH laws in force in the Territory which are inconsistent with the terms of this Order shall be null and void to the extent of such inconsistency. ARTICLE VI EFFECTIVE DATE This Order shall enter into effect in the Territory or any Area thereof on the date of signature. Dated at, TRIESTE, this 19th day of January, 1946. BOWMAN, Colonel, J.A.G.D.,Senior Civil Affairs Officer ' ORDER 1. — Dott. GUIDO HUGUES, Corso Roosevelt, 16, Gorizia, is hereby appointed Commissario Straordinario of Ente Nazionale per le Tre Venezie to administer and supervise all the property and affairs of said Ente within the Territory. 2. -—- The said Commissario Straordinario shall perform the above functions under the supervision, control, and directives of the Allied Military Governement. 3. — This Order shall take effect on the date that it is signed by me. Colonel, J.A.G.D., Senior Civil Affairs Officer of those parts of Venezia-Giulia which are administered by the Allied Military Government, do hereby ORDER that GIOVANNI BEZZI be and he hereby is appointed Sequestrator for the „DANUBIO-CONCORDIA“ Soeietà Anonima di Assicurazioni Generali in those parts of Venezia-Giulia occupied by the Allied Forces, to conduct such office in accordance with instructions and directives, and under supervision and control of the Allied Military Government. This Order shall take effect immediately and shall be operative until further order. EDMONDO PUECHER President Territorial Epuration Commission of Appeal PART III RULES OF PROCEDURE OF THE EPURATION COMMISSION OF APPEAL - TRIESTE POWERS AND FUNCTIONS OF THE COMMISSION Article 1 — Any person who wishes to appeal against a decision of an Epuration Commission of First Instance may lodge a written petition at the offices of the Epuration Commission of First Instance, within 14 days from the date on which the order from which he wishes to appeal has been notified to him, or, for cases heretofore decided by the Commission from the date on -which these rules are published. On the petition for appeal the applicant will indicate or attach any documents or evidence which he intends to use to sustain his petition. If applicant has a lawyer his name will be stated. The Office of the Commission of First Instance will immediately transmit to the Commission of Appeal, the application with the file containing all records on said case. Article 2 — The petition for appeal does not suspend the execution of an order of a Commission of First Instance. Article 3 — The President will receive and examine such applications and will forward them to one of the two Sections, and will charge one of its members with the duty of preparing and presenting the case to his Commission for consideration. Article 4 —- The President may, after examination of the application refer it to the full Commission for consideration, and will charge one of the members of the Commission with the duty of preparing and presenting the case. - ' Article 5 — The President of the Commission will call the meetings of the Commission, at which at least 6 of the 12 members must attend, including the President or the Deputy President. The President, or in his absence the Deputy President or Vice-President, may call meetings of sections and preside over such meetings. 4 of the 6 members must attend to make a Section meeting valid. Article 6 — The President of the Commission will determine the date of the public hearing of the appeal by the Commission or a Section thereof and will give notice of such date to the persons interested, except that the Commission or a Section thereof shall have the right, with the prior approval of the President or in his absence the Deputy President, to decide that a case or cases will be decided on the written record only and that no public hearing will be granted. Article 7 — The Commission or a Section thereof will examine at the public hearing the report of the case, and then the defence by the accused or by his lawyer. The judging assembly has further power to hear witnesses, to administer oaths, and to exercise all powers created by Article 338, 342 and 343 of the Code of Penal Procedure. The presiding member, through him, may ask questions of the appellant or of his attorney or of any witness. The appellant, or his attorney may question witnesses through the acting President. Article 8 — At the end of public hearing, the judging assembly will retire to decide on the appeal and will ballot on matters proposed by the presiding member, and confirm or quash the order against which the appeal was made, or alter or vary such order in such terms as to it may seem just and proper, provided however, that it shall not impose a granter penalty than was previously imposed or it may order such case be reconsidered by a Commission of First Instance or may order that the case will be further inves.igated and reconsidered by the Commission of Appeal. The presiding member of the hearing votes last. In case of tie his vote determines the question in issue. At the reopening of the hearing, the decision, with a summary of the reasons for it, will be published by the presiding member. Such decision will be include in the record of the hearing.. Article 9 — The decision signed by all members of the Commission, or of the Section thereof, will be attached to the original file and a certified true copy will-be served upon the interested party and upon the Commission of the First Instance from whose decision the appeal was taken. The original file will be kept in the Archives of the Commission of Appeal. • Article 10 — Cases of appeal against a decision of a Commission of First Instance or on application for reinstatement in office from which the appellant has been suspended or dismissed during the period from the liberation from the Germans (1 May 1945) and the effective date of General Orders 7 and 8 (30 July 1945 for Trieste Area ; 8 August 1945 for Pola Area and 31 July 1945 for Gorizia Area) (Section XIII of General Order 7 ; paragraph 14 of Administrative Instructions 15 July 1945 ; Section XI of General Order No. 8 ; and para 1 of Administrative Instructions 16 August), will be considered in accordance to the rules of the appeals in general. Administrative Order N. 23 APPOINTMENT OF DR. MARIO TRIPCOVICH AS SPECIAL COMMISSARIO FOR CASSA MARITTIMA ADRIATIC A WHEREAS it has been deemed necessary to provide for a temporary administration of the „Cassa, Marittima Adriatica per gli Infortuni sul Lavoro e le Malattie“ in those parts of Ve-nezia-Giulia which are administered by the Allied Military Government, NOW, THEREFORE, 1, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, hereby ORDER as follows : ARTICLE I Dr. MARIO TRIPCOVICH is hereby appointed to be the Special Commissario of „Cassa Marittima Adriatica per gli Infortuni sul Lavoro e le Malattie“. He shall remain in office until further order of the Allied Military Government, or until a successor or the Statutory Board is lawfully provided. ARTICLE II The powders of the special Commissario shall be as follows : (a) To act for Cassa Marittima Adriatica and to exercise all normal administrative finitions. (b) The Special Commissario shall not, except wdth the written consent of the Allied Military Government, do any act outside the normal scope of management. (c) Tne provisions of Article 2366 et seq. of the Italian Civil Code shall apply, to the Special Commissario. ARTICLE III The Special Commissaro shall have the following duties : (a) to take possession of all documents, moneys, property and other assets of Cassa Marittima Adriatica and to make an inventory thereof as. directed by the Allied Military Government ; (b) to submit to the said Allied Military Government, whenever so directed, a detailed report on the administrative and financial position of „Cassa Marittima Adriatica“ and to otherwise at all times comply with the orders, instructions and directions issued by the said Authority. ARTICLE IV This Order shall be effective on from and after the date upon 'which it is signed by me. Dated in Trieste this 24th day of Jan., 1946. * ALFRED C. BOWMAN Colonel, J.A.G.D., Senior Civil Affairs Officer Administrative Instruction - Education, No. 2 SCHOOL TEXT-BOOKS, INSTRUCTIONS FOR COMMUNAL PRESIDENTS, G.I.L. 1. — School Textbooks. fa) You will transmit to each bookstore and publisher in your area a copy of the accompanying pamphlet, „Pefascistizzazione dei Libri di Testo“, and order them to follow the Instructions bn the front cover thereof. Said Instructions are hereby made a part of this Administrative Instruction. (b) Within three weeks you will report to the Area Commissioner what stores and publishers have been so notified, which ones have reported to you, and what steps have been taken to enforce this order. (c) You will order confiscated all books containing Fascist propaganda (including any books in Appendix B of „Defascistizzazione dei Libri di Testo“) in the schools of your Area, and request the Superintendent of schools to instruct all Head of secondary schools and Diret-tori Didattici to turn said books over to the Communal President in each Commune or to store them in a locked room, notifying you as to the number of such books disposed of anywhere they have been stored. 2. r— Administrative instructions for communal presidents. (a) You will transmit to each Communal President in your Area a copy of Administrative Instruction No. 3. Proper forms for Communal Presidents requesting of school lunches will be provided in due course. (b) When Communal Presidents return the completed forms for school lunches to you, you will transmit them, e,s they come in, to the Area Commissioner. 3. — G.I.L. (Gioventir Ita iana Liitorio) fa) All activities carried on by ex-G.I.L. are suspended. (b) The Superintendent of Schools is appointed temporary custodian of all properties of ex-GIL in the Area, and is also given charge of personnel of ex-GIL, in accordance with directives issued by Allied Military Government. BOWMAN Colonel, J.A.G.D., Senior Civil Affairs Officer ALLIED MILITARY GOVERNMENT 13 CORPS Administrative Instruction - Education, No. 3 CONFISCATION OF TEXT-BOOKS, SCHOOL BUILDINGS, SCHOOLS DEPENDENT ON COMMUNES, SCHOOL LUNCHES 1. — Confiscation of tex. books. 1. — The possession and circulation of any book containing Fascist propaganda is punishable under military law (Proclamation No. 1, Article 5, paragraph 43). 2. — All former State elementary school textbooks and a number of others contain Fascist propaganda. All books-stores and publishers in every Commune must therefore be notified immediately by the Communal President that they shall, within two weeks, take the following actions, and report back through him to the Area President that they have done so: a) Turn over immediately to the Communal President all books declared confiscated in Appendix B of „Defaseistizzazione dei Libri di Testo“, which has been sent to the Area President for transmission to them. In lieu of turning such books over to the Communal President., however, the bookstores or publishers may, with his consent, store said books in a locked place, notifying him as to the number of books so stored and the exact location of them. • b) Cut out pages, as indicated, from book listed in Appendix „0“ of „Defaseistizzazione dei Libri di Testo“ and turn over the excised pages to the Communal President. 3. — Books and pages delivered to the Communal President by bookstores or publishers in accord with paragraph 2 above, will be safely stored by him subject to later orders of the Superintendent of Schools. Similar disppsitions will be made of Fascist books turned over to the Communal President by Heads of secondary schools or by Directors of elementary school on order of the Superintendent. 4. — The Communal President will have suitable investigations made to see that no unauthorized books are being displayed or sold, and report violations to the Questura. 2. — School Buildings. 1. —- Immediate steps will be taken by the Communal President to find suitable loea -lions for the elementary and secondary schools of his Commune, Slovene and Italian. Should the school buildings be so badly damaged as to be unusable, should they be occupied by troops or should they be occupied by refugess for whom it is impossible to find any other accommodation in all such cases the Communal President will find other suitable roonjs for school purposes, or, if no other means can be found, he may arrange that teachers take the children, in turns, into their homes for instruction. 2. ■— It will be the Communal President’s responsability, where necessary, to have school premises, cleaned, repaired and otherwise put in proper order. School benches and other equipment necessary will be placed by him in the location selected. 3. — The Communal President will select personnel for the operation and maintenance of buildings subject to the approval of the Area Superintendent of Schools. 4. — Upon the advise of the Superintendent of Schools the Communal President will find and purchase for resale to students such school supplies as are necessary. 5. — The Communal President will report immediately to the Superintendent of Schools that these orders have been followed. 3. •— Schools Dependent on Communes. 1. — The Communal President will make also arrangements for the opening of all schools which were formerly dependent on the Commune, subject to the approval of the Chief Education Officer of the Allied Military Government. 2. — The Communal President will arrange for such payment of teachers and other-expenses as is normally made by the Commune, 3. —. The Communal President will report to the Superintendent of Schools when the above arrangements have been made. 4. ■— School Lunches. 1, _ The Allied Military Government will, as far as possible, make available to the Communal President for the children in „asili“ and elementary schools, school lunches on a x basis to be determined. 2. .— The Communal President will make every effort to see that each school and asilo in his Commune has facilities for preparing and serving food alloted. The teachers and Diret-tori Didattiei will be glad to cooperate with him in making these arrangements. He may also enlist the help of parents. 3, _ As soon as arrangements have been made for serving the lunches the Communal President will fill out the specified form and send it to the Area President for the Area Commissioner. 4. _ The allotments for schools lunches will be included in the regular supplies of food to each Commune through „SEPRAL“ and the Consorzio Agrario. The Communal President will collect and pay for the supplies just as he does for all other food supplies from this source. August, 1945 Administrative Instruction - Education, No. 4 SPECIAL ORDERS AND AUTHORIZATION FOR OPENING AND FUNCTIONING OF SCHOOLS IN VENEZIA GIULIA, ALLIED MILITARY GOVERNMENT I. — ITALIAN LAW 1. — All existing Italian Laws and regulations prior to September 1943, relative to the educational system and the functioning of the schools shall continue in full force except where the present orders and authorizations negate, replace or supplement them. In general it is the policy of the Allied Military Government to avoid any change in the legal situation, the administrative organization, or the school program, except where changes are necessary to eliminate Fascism or to make schools function effectively. 2. •—■ The Italian Minister of Public Instruction has no jurisdiction over the territory of Venezia Giulia under Allied Military Government. All public and private schools are under the jurisdiction of Allied Military Government •— 13 Corps, Education Division. II. — ADMINISTRATION 1. ■—-As Area Superintendent of Schools you will be responsible for the organization and administration of all elementary schools of the Area. 2. — You will first put in order the Office of the Superintendent and employ sufficient staff to operate the schools efficiently. These appointments must have the approval of the Area Commissioner. 3. — With the approval of the Chief Education Officer, you will be responsible for the confirmation of all Heads of secondary schools, and all Inspectors and Directors of elementary schools in the Area, who are not suspended (see IV below). To replace any such officials who may be absent or any who may not be approved, you will appoint (with the approval of the Chief Education Officer of the Allied Military Government) other qualified persons „incaricati“ for terms not to exceed one year. III. — OPENING OF SCHOOLS 1. •—- All schools will be opened on a date fixed and notified to you by the Area Commissioner. 2. — Before any given school is opened you will give a copy of Administrative Instruction No. 5 to the Head of the secondary school, or the Inspector and Director of the elementary school, concerned. 3. •—• You will be personally responsible for seeing that no Fascist doctrine is taught and no Fascist rites, cerimopies or symbols are used, and no anti-Allied propaganda is promulgated in any school under your jurisdiction. 4. — Asili and Private Schools will also be opened at the earliest time possible. These will first have the approval of the Area Commissioner. They will be under the general supervision of the Superintendent of Schools, expecially in regard to the use of approved programs and textbooks and the avoidance of Fascist activities and propaganda. IV. — DEFASCISM L •— Within 10 days you will submit to the Area Commissioner, for the Chief Education Officer, Schede Personali for all Heads of secondary schools and all Inspectors and Directors of elementary schools in the Area along with recommendations concerning their retention or suspension. For those who are unable, through absence or other cause, to submit Schede you will submit a list of such persons who should be suspended or confirmed and give reasons for your recommandations in each case. 2. —• It will be your responsibility to submit Schede Personali for teachers of all grades and for all employees of your administration to the Public Instruction Section of the Area Commission for Epuration. 3. — You will be notified in writing by the Area Commissioner of those whom he has suspended. Following such notice you will transmit this information to the individual concerned notifying them of their right to appeal before an Area Commission. Personnel suspended or dismissed by the Area Commission for Epuration, will be dealt with in accordance with General Order No. 7. 4. ■— Such persons as are suspended must be replaced by „incar icati“, by persons whom the Superintendent of Schools considers to be trustworthy, non-fascist and competent. The names and positions of such persons must be submitted to the Area Commissioner for the Chief Education Officer. Within 10 days, a completely filled out Scheda Personale for each of these officials must be submitted to the Area Commissioner for transmission to the Chief Education Officer and approved by him. Until such approval is obtained, all appointmenst shall be regarded as provisional. 5. -— All newly-appointed Heads of secondary schools and all newly appointed Inspectors and Directors of elementary schools shall be „incaricati“. 6. •— In complying with the foregoing your attention is called to General Order No. 7 of the Allied Military Government on the basis of which the following persons are suspended from service : a) Any person, particularly one in high office, who has partecipated notively in the political life of Fascism, or, by showing himself as a consistent apologist of Fascism, has shown that he is unworthy of serving the State. b) Any person who has obtained an appointment or promotion through favoritism of the party or of Fascist officials of high rank. c) Any person who has been guilty of active Fascist partisanship or corrupt practice. d) Any person who has held the position of „Squadrista“, „Sansepolcrista“, „Antemareia“ „Marcia su Roma“, „Sciarpa Littorio“ or who has been an officer in the Fascist militia. e) Any person who, after 8 September 1943, followed the Fascist Government to the North of Italy, or who has pledged allegiance to or has in any way collaborated with said Fascist Government. V. — TRANSFERS OF TEACHERS 1. •—• Transfers of teachers and other school personnel during the school year will be kept to a minimum and only considered where really necessity exists. Transfers from lower to higher position will be considered only in exceptional cases. 2. •— Request for transfer may be made by the teacher or other person concerned to the Superintendent of Schools in the Area in which the person in question is residing at the time. 3. — Any Superintendent, convinced of the need for a transfer, may, either on his own initiative or on request of the person concerned, make appropriate application to the Area Commissioner for transmission to the Chief Education Officer. 4. •—• With the approval of the Senior Civil Affairs Officer, teachers in one Area may be given „comandi“ for service in another Area in Military Government territory for periods not to exceed one school year. VI. — ORGANISATION OF SCHOOLS 1. — You will submit to the Area Commissioner for transmission to Headquarters 13 Corps Allied Military Government the following information at the earliest possible date: a) Names of all Presidi and other secondary schools-Heads and the name and type of school which each will direct. b) Names of Inspectors of elementary schools and the commune under the jurisdiction of each. c) Names of Directors of elementary schools, and the „circle“ each will direct. d) A list, on the form provided, of all schools in the Area which operatin normal times. 2. •— The organisation of asili and elementary schools will remain the. same as that which existed during the past year. 3. — The Scuola Media Unica will be known as the Scuola Media Inferiore. It essential structure will remain unchanged but all Fascist elements will be removed and replaced. The course of all Scuole Medie Inferior! will be three years in length. 4. ■—• Whether independent or attached to an Istituto Magistrale, an Istituto Tecnico, a Liceo Scientifico, or a Ginnasio Superiore and Liceo Classico, certificate of graduation from any Scuola Media Inferiore will admit any student to any type of higher secondary school. 5. ■—Superior Secondary Schools will be as follows : a) Istituto Magistrale — four years b) Istituto Tecnico — five years c) - Liceo Scientifico — five years cl) Ginnasio Superiore •— two years e) Liceo Classico .—• three years 6. •—- When a Superintendent of schools finds that in a commune there are a number of children desiring secondary education, that no appropriate secondary school exists in that Commune, and that there is no adequate trasportation available to enable children to attend an existing secondary school in a neighboring Commune, the Superintendent of schools is authorized, upon approval by the Senior Civil Affairs Officer to arrange with a secondary school in another commune to establish classes „distaccate“ in the commune which needs them. 7. —■ Elementary schools conducted in the Slovene or Croat language for Slovene or Croat students will be opened wdierever needed and will be alloted in proportion to the Slavic population of each locality. The opening of each such school will be approved by the Senior Civil Affairs Officer. Locality number of students enrolled, number of personnel employed and their qualifications will be listed in the request for approval of each new school. 8. •—- Secondary schools conducted in the Slovene Language for Slovene students will be opened upon approval of the Senior Civil Affairs Officer. Approval of new secondary schools will be based on : a) Number of students enrolled b) Qualification of teachers c) School buildings available. VII. — PROGRAMS OF STUDY. 1. — Programs for all elementary and secondary schools in whatever language conducted, shall be those authorized by the Senior Civil Affairs Officer. The Superintendent of schools will be responsible for the execution of this order. 2. For the schools of „Avviamento Professional“ and the „Scuole tecniche“ no new programs have been prepared. Directors and teachers of such schools may use as a base the old programs with all elements of Fascism removed, but may modify these programs freely to fit local conditions and needs. VIII. — TEXTBOOKS 1. •— Anti-fascist materials (a) You will be personally responsible for seeing that no textbooks containing fascist or anti-ally propaganda are used in any schools under your jurisdiction. Appendix ,,B“ in the „Elenco Ufficiale“, which accompanies this Administrative Instruction, lists certain books which contain such propaganda and which must be immediately confiscated. Appendix „0“ Lists books which may be temporarily used after the removal of the pages indicated. Appendix ..D“ is a list of books approved to date for use. (b) An order is being sent to the Area President of each Area requiring him to confiscate from schools and bookstores all books listed in Appendix ,,B“. You will receive later instructions as to the ultimate disposition or these books. You will order Heads of secondary schools and Directors of elementary schools to segregate and store in locked room or turn over to the Communal President all books containing Fascista propaganda including those of Appendix ,,B“ as showm in the abbreviated pamphlet „Defascistizzazione dei libri di testo“ a copy of which you will sent to each school-Head, Inspector and Director (sufficient copies are en closed herewith). School Heads and Directors will report to you and you in turn will report to the Area President the number of such books segregated and the location where they are stored. You will be responsible for inspecting schools and bookstores and reporting to the Area President failure to obey these orders. (c) You will obtain from the Communal President and furnish to the Area Commissioner for transmission for the Chief Education officer a list of all books confiscated, the number of each, and the location in which they are stored. 2. •— Elementary School Textbooks The Superintendent of Schools will recommend to the Area Commissioner, for reference to the Chief Education officer, a list of persons, to form two Committees (one Slav and one Italian) on elementary school text books. The committees will, at the earliest possible moment, recommend for use for the school year 1945-46 any existing text books or proposed manuscripts which are free from fascist or other political propaganda, and are in accordance with the of- ficial programs, and are otherwise suitable in content and price for use in the elementary schools. The Superintendent of Schools will immediately submit these recommendations to the Area Commissioner for the Chief Education officer. Only such books as are apjDroved by the Chief Education Officer will be sold or bought, or used in the schools. 3. — Secondary School Textbooks In all secondary schools, public and private, only textbooks authorized by the Education Division, 13 Corps AMG, shall be used. Appendices B, C, D, in the accompanying „Elenco Ufficiale“ list textbooks that are condemned and those that are approved. Books not included in these lists or supplements hereto are to be treated under two categories as follows : (a) Textbooks in Greek, Latin, Mathematics, and physical sciences, and purely technical books in the applied sciences or arts, may be approved by the Superintendent of Schools, subject to the approval of the Area Commissioner, provided that a list of such approved books must be sent by the Superintendent of Schools through the Area Commissioner, to the Chief Education Officer with title, author, publisher and price of each. (b) The Superintendent of Schools shall send to the Area Commissioner for the Chief Education Officer, a sample of each book which he wishes to have approved for use in schools under his jurisdiction. He may use such books temporarily pending a decision from the Area Commissioner. 4. — Price of Textbooks (a) The maximum sale price of all books have been established as follows : ---For folio sizes up to 70 X 100 cm., for each printed sheet of 16 pages, L. 5. —• For folio sizes over 70x100 cm., for each printed sheet of 16 pages L. 6. -—- For illustrated books (at least one illustration to each to sixteen-page folios, included in the text or outside of text), an increase of 15% on price fixed on number of printed sheets as above. — For geographical atlases, albums of design, albums of history, of art and for special publications, an increase of 100% over the original cover price. (b) For special books and new editions the price will be fixed by Allied Military Government from time to time according to the request made by the interested publishers. The new price must appear on a small label on which will be clearly indicated : The name of publishing House, the new price and the statements „price authorized by Allied Military Government“. (c) No other increase will be made in these new prices. The booksellers will receive a discount of 25% on secondary school textbooks, 20% on elementary school textbooks. The general tax rate remains in force. (d) Any book may be sold at a price lower than that fixed above ; but no book shall be bought or sold, at a higher price. (e) The price of elementary school textbooks shall be that printed on the cover. Alternation of this price or the sale of books at a higher price is strictly forbidden. _5. — Publication and sale of textbooks: (a) No textbooks shall be published except as authorized in writing by the Education Division, Allied Military Government. 6. ■— Elementary school textbooks for 1946-47 must be approved by proper authority before publication. Applications and manuscript for such textbooks must be submitted to the Area Commissioner for transmission to the Chief Education Officer. 7. —- With the approval of the Area Commissioner, the Superintendent of schools is autho- rized to purchase, for resale to students, textbooks, tjuaderni and school supplies, whenever insufficiency of means of commercial distribution, or prices charged by commercial organization, make such action desiderable. IX. — STUDENTS. 1. —• Superintendents of Schools are authorized to permit transfer of students at any time from any school to another of the same level. 2. — Fees of the Scuola Media Inferiore shall be the same as those charged for the Scuola Media .Unica formely. 3. — Other tuition fees will remain the same as those charged during the school year 1942-43. * ' 4. — With the approval of the Area Commissioner the Superintendent of Schools may provide for examinations of students in secondary schools at other than the regularly specified times and places. X. — BUILDINGS AND EQUIPMENT 1. — The Superintendent of Schools will consult with Communal Presidents concerning necessary buildings, location, temporary repairs of buildings and the requisition of other buildings for school purpose when buildings have been damaged or destroyed. 2. — Where necessary the Superintendent of Schools will assist in finding locations for school purpose. He may, when necessary, require teachers to hold classes in their own houses. 3. —■ Within thirty days from receipt of these orders, the Superintendent of schools will report on the condition of all school buildings of the Area to Area Commissioner, naming thoseadamaged or destroyed, and those occupied by troops, refugees, and other personnel, with the address of each and an exact description of any civilian occupying group. XI. — FINANCING SCHOOLS 1. ■— Budgets (a) For the payment of elementary teachers’ salaries and for other expenses of the Superintendent’s office the Superintendent of Schools will prepare and file with the Inten-denza di Finanza proper form furnished by the Area Financial Officer. (b) The Superintendent of Schools will see that each Head of secondary school prepares and files with the Intendenza di Finanza the necessary budgets. 2. — Payment of Teachers’ Salaries (a) The treatment accorded to teachers will conform in principle to that approved for other public employees. (b) The procedure of payment will be according to the laws and regulations in force, subject to any amendments by Allied Military Government. (o) With respect to unpaid salaries relating to periods during the Fascist regime, the Intendente di Finanza will supply the details for processing of such claims. (d) Salaries for the period subsequent to the Nazi-Fascist regime will be provided through the normal budget system referred to in the preceding section. (e) All school personnel ,,di ruolo“ will be paid according to para a) above. (f) School personnel „incaricati“ will be paid as from the first day of the month in which they begin service. ^ School personnel ;,supplenti“ will.be paid for the actual days of service. (h) Full salary will be paid to a person proposed for suspension or dismissal until such time as Allied Military Government or the Epuration Commission takes final action of suspension or dismissal. XII. — G.I.L. (GIOVEXTU’ ITALIAN A L1TTORIO) 1. — Activities and properties of GIL (a) All activities carried on by ex-GIL are suspended. (b) The Superintendent will as soon as possible arrange to take over from the Intendenza di Finanza all ex-GIL property which is necessary or desirable for the training, recreation ,or welfare of children or youth. (c) He will give the Intendenza di Finanza a receipt for such property and from the personnel dependent from his office he will appoint a custodian or custodians to take care of such property. (d) He will transmit copies of the inventory to the Area Commission for the Chief Education Officer. (e) Temporary concession for use of movable and immovable property belonging to ex-GIL may be accorded — with such precautions for its safety as in each case may appear appropriate ■— only by the Superintendent of Schools concerned, and solely for school purpose or to youth organizations of a cultural, recreative, sportive, or charitable character. (f) Subject to proof of right to continued employment under the Allied Military Government orders on defascism, teachers of physical education previously employed by the ex-GIL will be temporarily assigned, under the jurisdiction of the Superintendent of Schools to the secondary schools of the Area. 2. *— Payment of Salaries of Physical Education Teachers (a) Payment of salaries will be according to Section XI, para 2a. (b) The Superintendents of Schools will make such payments as they think due, reserving rights of adjustment later. It is considered advisable that such allowances only be paid as are provided for a professor „incaricato“ with a maximum of 26 hours of teaching. 3. •— Dismissals of former G.I.L. employees fa) The Superintendent of schools will dismiss all personnel ,.di ruolo“ of ex-GIL who have not been previously dismissed by order of the Allied Military Government (other than physical education teachers who will be dealt with as in paras 1 and 2 above). They will be paid whatever indemnities are due to them under the existing law. (b) Temporary employees of ex-GIL will also be dismissed by the Superintendent who will pay them an allowance or half a month’s pay for every year of service. XIII. — SCHOOL LUNCHES 1. — The Allied Military Government will, as far as possible make available t ..asili” and elementary schools in each commune a given amount of suitable foods for school lunches. The price to be paid by the Commune, will be fixed by arrangement between the Communal President and the Consorzio Agrario. 2. ■—■ It is the responsibility of the Superintendent of Schools through „Direttori Di-dattici“, to cooperate with the Communal Presidents in making provision in each elementary school for the preparation and serving of the lunches. 3. — Full instructions will be sent to the Area President to all Communal Presidents as to how to apply for these lunches. XIV. — REPORTS During the first month you will report weekly and thereafter monthly to the Area Commissioner for the Chief Education officer concerning the status of the schools in your area, and will include the statistical reports called for on forms which will be furnished to you by the Chief Education Officer. Senior Civil Affairs Officer ALLIED MILITARY GOVERNMENT 13 CORPS Administrative Instruction - Education, No. 5 SPECIAL ORDERS AND AUTHORIZATION FOR OPENING AND FUNCTIONING OF SCHOOLS 1. — Responsibility for all elementary and secondary schools of the Area has been vested in the Superintendent of Schools by the Allied Military Government. 2. — Heads of Secondary schools and Inspectors and Directors of Elementary Schools will therefore, in directing the school or schools undev their jurisdiction, act in accordance with Administrative Instructions issued by him. 3. — All Schools will be opened on authorization of the Superintendent of Schools after approval by the Area Commissioner. _ 4. — Heads, Inspectors, and Directors will be responsible for seeing that no ^Fascist doctrine is taught and no Fascist rites, ceremonies, or symbols are used, and no anti-Ally pro -paganda is promulgated in any School under their jurisdiction. 5. — They will report to the Superintendent of Schools concerning teachers under their direction who have had the title of „Sansepolcrista“, „Squadrista“, ,,Ante-Marcia“, „Marcia su Roma“, or „Seiarpa Littorio“, or have been officers in the Fascist Militia, or have participated actively in Fascist political life or have benefited by their affiliation with the Party. For such persons or for others about whose Fascist activities they are uncertain they will also forward to the Superintendent of Schools a Scheda Personale. 6. — They will remove from the Library of any School under their jurisdiction all books containing Fascist propaganda, including those in Appendix B of „Defascistizzazione dei Libri di Testo“, which is given to them herewith. These books will be counted and either stored in a locked room or deposited with the local Communal President. They will report immediately to the Superintendent of Schools as to the number of books so segregated and the place where they have been stored. 7. — They will assist the Communal President or Area President in finding a suitable location and equipment for the School or Schools under their direction. If necessary, because of lack of sufficient space, they will arrange for more than one session during the day to provide for as many children as possible. They may, where necessary, require teachers to hold classes in their own houses. 8. — Before the fifteenth of each month all Ispettori and Direttori Didattiei will report to the Superintendent of Schools the names of all teachers employed in the Schools under their direction. 9. — Before the fifteenth of each month each Preside or other secondary school Head will prepare for the Intendenza di Finanza a roll of teachers and other information necessary for the payment of personnel under his direction, and present this to the Superintendent of Schools. 10. — All School Heads (Italian and Slav) will keep the Superintendent of Schools informed to the time Schools open, the number of students enrolled, the number and type of teachers employed, the condition of buildings and other equipment, and such other matters-as may be requested. (c) The Senior Civil Affairs Officer will appoint from this list an advisory Committee to consider the political record of both the teaching and administrative members of the University Staff to recommend to him and the Commission of Epuration, established under GO 7, which members of the Staff should be retained, suspended or dismissed. (d) The names of persons suspended or dismissed by order of the Senior Civil Affairs Officer or the Committee of Epuration shall without delay be forwarded to the Chief Education Officer who wiil forward them to the Education Sub-Commission for information. (e) On the completion of this initial epuration : (I) The titular professors who have not been suspended will elect a Rector. (II) The epurated faculties will by election fill the office of Dean. (III) Any other appointments which it may be necessary Ao fill (except itular appointments which will be filled only by eoncorsi) will be filled on a temporary basis (incaricati). (IV) Courses will resume. RE-REGISTRATION OF BOATS ALREADY REGISTERED All boats requiring to be registered under the terms of this Order which have already been registered with any person or body, shall be re-registered with the said Harbour-Master under the terms hereof. ARTICLE 3. DECLARATION OF BOATS WAITING OR UNDER REPAIR All boats requiring registration under the terms of this Order which are awaiting or are under repair shall be declared to the said Harbour-Master. ARTICLE 4.
