A., Trieste - 1952 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 143 CESSATION OF APPLICATION OF THE WAR LAW PROVISIONS IN RESPECT OF JAPAN AND OF JAPANESE PHYSICAL AND JURIDICAL PERSONS WHEREAS it is deemed advisable to discontinue the application of the War Law in respect of Japan and of Japanese physical and juridical persons, in that part of the Free Territory of Trieste administered by the British- United States Forces, NOW, THEREFORE, I, J.E. FODE'N, O.B.E., Deputy Director General, Civil Affairs, ORDER: ARTICLE I The provisions of the War Law, as approved by R.D. 8 July 1938, No. 1415, and subsequent amendments and additions thereto, shall cease to apply, in so far as still effective and save the provisions of the following Article, in respect of Japan and of Japanese physical and juridical persons. ARTICLE II Without any change to the option established by article 2, No. 2, of the law 16 December 1940, No. 1902, the existing provisions shall continue to apply to property, rights and interests of which Japan and Japanese physical and juridical persons have become owners, entitled persons or beneficiaries prior to the effective date of this Order, provided, however, the said property, rights and interests have not been subjected, for whatever reason, to the measures set forth in R.D. 8 July 1938, No. 1415, and subsequent amendments and additions thereto. FODEN Deputy Director General, Ref. : LDfAI52f94 Civil Affairs ESTABLISHMENT OF A SUPERIOR COUNCIL FOR MINES WHEREAS it is considered advisable to establish a Superior Council for Mines, in that part of the Free Territory of Trieste administered by the British- United States Forces, NOW, THEREFORE, I, J.E. FODEN, O.B.E., Deputy Director General, Civil Affairs, ORDER: ARTICLE I A Superior Council for Mines is hereby established as an advisory body to the Department of Production, Allied Military Government in matters concerning mines and quarries. ARTICLE II The Council shall advise as follows : a) In those cases as required by existing laws and Regulations ; b) when requested to do so by the Department of Production. The Council may on its own initiative submit suggestions and proposals to the Department of Production. ARTICLE III The Council shall be composed of the following: a) a President; b) a member chosen from among persons qualified in legal matters ; c) two members chosen from among persons expert in geological and mining matters ; d) two members, one of whom shall represent the industrialists and one shall represent the „Camera del Lavoro“ ; e) a member representing the Department of Public Works and Utilities, Allied Military Government. The following shall be „ex lege“ members of the Council: the Director of „Istituto Geo-fisico“ and the Chief Engineer of „Corpo delle Miniere“ (Trieste District). In case of absence of the „ex lege“ members the meetings shall be attended by those officials substituting them in their respective offices according to the provisions in force. The President may call persons having a specific competence in the particular questions to be dealt with and, whenever matters concerning other Departments are to be examined, the representatives of the Departments or Offices concerned to take part in the Council’s meetings from time to time. The above members shall have consultative vote. ARTICLE V The presence of one half plus one of the Council’s members shall be necessary for the decisions to be valid. The decisions shall be taken by absolute majority of votes. In case of equal number of votes the President’s vote shall prevail. ARTICLE VI The President of the Council and the members mentioned sub letters b), c), d) and e) of Article III shall be appointed by Administrative Order upon proposal of the Chief, Department of Production ; they shall hold office for three years and may be re-appointed. The above mentioned Administrative Order shall likewise designate the Council’s member substituting the President in case of absence or inability to attend. ARTICLE VII The Secretariate services of the Council shall be carried out by officials of the Department of Production. FODEN Deputy Director General, Ref.: LD/A/521110 - Civil Affairs PROVISIONS CONCERNING JUDICIAL EVICTIONS WHEREAS owing to the acute housing shortage it is necessary to suspend for a short period of time evictions in that part of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, J.E. FODEN, O.B.E., Deputy Director General, Civil Affairs, ORDER: ARTICLE I The enforcement of all judicial orders ordering evictions from dwelling premises in the Commune of Trieste is hereby suspended and postponed until 31 December 1952. ARTICLE II The suspension or postponement of execution provided for in Article I hereof shall not apply to the following evictions: a) On grounds of non-payment of rent, b) Immorality, c) ,,Ai casi in cui il titolo esecutivo sia determinate da una sentenza in giudizio posses-sorio.“ or d) Squatters. ARTICLE III In those cases under Article II (a) where payment of rent has been after the order of eviction or arrangements have been made whereby the rent is to be paid under conditions satisfactory to the Pretore, the Pretore may suspend the execution for such period as he considers appropriate by unappealable decree. FODEN Deputy Director General, Ref.: LD/Af52/146 Civil Affairs RESTRICTION IN THE USE OF NICKEL, COPPER, ZINC AND THEIR ALLOYS, AMENDMENTS TO ORDER No. 170/1951 WHEREAS it is deemed necessary to amend Order No. 170 dated 27 October 1951, restricting the use of nickel, copper, zinc and their alloys in that part of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, J.E. FODEN, O.B.E., Deputy Director General, Civil Affairs, ORDER: ARTICLE I Section 1. — The manufacture of keys in „alpacca“ metal is hereby allowed provided the content of nickel in same is not over 15%. This provisions amends the restriction laid down n Table A, III, letter 1), attached to Order No. 170, dated 27 October 1951. Section 2. — The manufacture of watch cases in „Alpacca“ metal is hereby allowed, provided the content of nickel in same is not over 15%. This provisions amends the restriction laid down in Table A, III, letter r), attached to Order No. 170, dated 27 October 1951. ARTICLE II The prohibition of use of zinc and its alloys laid down in Table D attached to Order No. 170, dated 27 October 1951, is hereby suspended for an indefinite period. ARTICLE III The time-limit for the sale of the products which in terms of Order No. 170, dated 27 October 1951, must not be manufactured or used existing on 1 November 1951 or which came into existence as a result of subsequent completion of processes under way on said date is hereby extended up to 31 October 1952. FODEN Deputy Director General, Ref.: LD/Af52/137 Civil Affairs PROVISIONS CONCERNING THE ASSIGNMENT OF HOUSES FOR THE HOMELESS WHEREAS it is considered necessary to amend the present regulations concerning the assignment of houses built solely with State funds in the Commune of Trieste, within that part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, J.E. FODEN, O.B.E., Deputy Director General, Civil Affairs, ORDER: ARTICLE I The assignment of dwellings built for the homeless with State funds within the area of the Commune of Trieste shall be made by a Commission, having its seat at the Office of the „Istituto Autonomo Case Popolari“, and composed of the „Pretore graduatore degli sfratti“, who shall preside over it, of the President of „Istituto Autonomo Case Popolari“ or a delegate of his, a representative of the Zone President’s Office, a representative of the Commune of Trieste and a representative of the „Istituto Antonio Caccia e Maria Burlo-Garofalo “ in Trieste. The Commission shall take its decisions by majority of votes. In case of equal number of votes the President’s vote shall prevail. An official of the „Genio Civile“ and a representative of the ,,Ente Ausiliario Assistenza Sociale“ Office may be called to participate in the meetings of the Commission with advisory vote. Applications for assignment of houses must be addressed to the Commission at the above address. ARTICLE II Within the time-limit of fifteen days from receipt of the registered letters by which the abstract of the decision taken by the Commission on the application for assignment has been communicated to the persons concerned, any person concerned may file a complaint with the Tribunal which shall decide in Chambers within thirty days. ARTICLE III Assignment of housing within the other Commîmes of the Zone shall continue to be made by the „Istituto Autonomo Case Popolari“ in conjunction with the Communal administration.
