La Editoriale Libraria, Trieste - 1948 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 137 PRÔVIS10NS CONCERNING ECONOMIC SECRETARIES AND VICE SECRETARIES OF THE INTERMEDIATE TECHNICAL INSTITUTES AND SCHOOLS WHEREAS, it is considered advisable and necessary to amend and to integrate the provisions of Order No. 290 dated li January 1947 relating to the legal position and economic treatment of the economic secretaries and vice-secretaries of the intermediate technical institutes and schools in that Zone of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I INSCRIPTION IN THE ROLLS OF ECONOMIC SECRETARIES IN SERVICE Article II of Order No. 290 dated 14 January 1947 is hereby amended and integrated to read as follows : 1. — „The economic secretaries who were in service on 16 October 1945 at the intermediate technical institutes and schools of the Territory, shall be inscribed in the Rolls established by the provisions of Article I of this Order. With effect from the aforesaid date, such secretaries shall be entitled to the grade and qualification corresponding to the years of service performed according to the former Rolls and as.provided for by the Table set forth in Article I for the promotion to grades subsequent to the eleventh, with deduction of the years as prescribed by the aforesaid Table for the period of service in grade twelve. 2. — The inscription in the new Rolls shall take place following the favorable result of a special inspection to be ordered by the Office of Education of the Allied Military Government. 3. — The promotion to grade 9th of economic secretaries mentioned in this Article for which a seniority of service of nine years is required shall take place on the basis of the required seniority of service only as long as the prescribed examinations of special merits and ability pursuant to Article 8 of R. D. 6 January 1942, No. 27 áre suspended. 4. — The economic secretaries, whose qualification has not been recognized for inscription to the grade corresponding to their seniority of service, shall be assigned to grade 11 of the new Rolls and be excluded from promotion to subsequent grades.“ INSCRIPTION IN THE ROLLS OF VICE SECRETARIES IN SERVICE Article III of the above mentioned Order is hereby amended and integrated as follows : 1. — „The vice-secretaries who were in service on October 16th 1945 at the intermediate technical institutes and schools of the Territory, shall be inscribed in the Rolls established by the provisions of Article 1 of this Order. With effect from the aforesaid date, such economic vice-secretaries shall be entitled to the grade and qualification corresponding to the number of years of service performed according to the former Rolls and provided for by the Table set forth in Article I for the promotion to grades subsequent to the 12th. 2. — The inscription in the new Rolls shall take place following the favorable result of a special inspection to be be ordered by the Office of Education of the Allied Military Govern -ment. 3. The promotion to grade 9th of vice-secretaries mentioned in this Article for which a seniority of service of twelve years is required shall take place on the basis of the required seniority of service only as long as the prescribed examinations of special merits and ability pursuant to Article 8 of R. Army Director General, Civil Affairs Order No. 104 ESTABLISHMENT OF TERRITORIAL FISHING COMMITTEE WHEREAS, it is deemed necessary and’ advisable to consolidate the duties of certain offices, Commissions and Committees created- pursuant to Article 1, 4 of the R. D. 21 June 1928, No. 1727 ; R. D. 20 May W25, No. 1140 ; Article 1, L. 24 March 1921, No. 312 and Article 34, para 7 of the same Law and substituted by the Consolidated Text concerning Fishing as approved by R. D. 8 October 1931, No. 1604. Article 16, 19, and to make certain other amendments thereto, within that Zone of the Free Territory of Trieste occupied by the British-United States Forces, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, 0 R D ® R : ARTICLE I REPEAL OF FORMER LAW Article 19 of the Consolidated Text relating to Fish regulations as approved by R. D. dated 8 October 1931, No. 1604, be and the same is hereby repealed. ARTICLE II CREATION AND COMPOSITION OF COMMITTEE There shall be hereby constituted at Trieste a Territorial Fishing Committee (Comitato Territoriale per la Pesca) which shall have its office at the Agriculture Office of the Allied Military Government and which shall be composed cf the following ten ( 10) members to be appointed by the Officer of the Agriculture Office upon proposal by the interested organizations : 1) A representative of the Port Director; 2) a legal expert with particular knowledge of laws on fishing (to be designated by the Port Director) ; 3) a representative of the Finance Department ; 4) the Director of the Fishing Protective Association (Consorzio Tutela Pesca) ; 5) the Director of the Meteorological Institute (Istituto Talassografico) ; 6) a representative of the Chamber of Commerce ; 7) a representative of fishermen (to be designated by Consorzio Tutela Pesca) ; 8) a representative of commercial fish canneries (to be designated by Industry Department) ; 9) a representative of fishing merchants (to be designated by Commerce Department) ; 10) a biologist expert in fishing (to be designated by Education Office). The Agriculture Officer, by virtue of his Office, shall be' the President of the Committee and preside at its meetings. The Vice-President and Secretary shall be elected from among the members of the Committee by secret vote. An official of the Agriculture Office, particularly versed in fishing regulations, shall be a member of the Committee and shall be its permanent Vice-Secretary without the right of decisive vote. The term of office of the members of the Committee shall be three years and they may be re-appointed. ARTICLE III PREVIOUS REFERENCES All references to the Central Fishing Office (Ufficio Centrale Pesca), to the Consultive Commission (Commissione Consultiva) and to Permanent Fishing Committee (Comitato Permanente della Pesca) of the Consolidated Text concerning fishing shall be construed as referring to the Territorial Fishing Committee as hereby established. SUFFICIENCY OF APPOINTMENT Upon approval of designations and appointment of members by the Agriculture Officer of Allied Military Government, the said Committee shall be formally constituted and have the same effect as if appointed by the within Order. ARTICLE V EFFECTIVE DATE This Order shall become effective upon the date of its publication in the F.T.T. Official Gazette. Dated at TRIESTE, this 5th day of February 1948. Order No. 141 REGULATIONS FOR ADMISSION OF FOREIGN STUDENTS IN THE UNIVERSITY OF TRIESTE WHEREAS it is desired to promulgate standard rules and requirements for the admission of students from foreign countries to the University of Trieste, and WHEREAS it is advisable to authorize the University of Trieste to conduct certain examinations to determine the eligibility of students to pursue their studies at the said University, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I ENROLLMENT REGULATIONS The following rules and regulations shall be applicable to all foreign students desiring to matriculate in the University of Trieste : 1. — Foreign students may be regularly registered at the University of Trieste, provided that their school certificates are recognized as sufficient and equivalent to those issued by senior high schools of the Free Territory of Trieste (British United States Zone). 2. — School certificates issued by foreign scholastic institutes shall be accepted only when the University is well informed about the organization of studies of the said institutes and when their perfect equivalence can be ascertained, as in cases of school certificates issued in the Italian Republic or other countries, where the organization of studies is similar. 3. — School certificates obtained in countries where' the organization of studies is different shall not be considered as valid and sufficient. 4. — Foreign students desiring to register in the University of Trieste, having school certificates not considered valid and sufficient, may be allowed to undergo matriculation examinations. 5. — The admission to these examinations shall be granted exclusively by the Coucil of the concerned Faculty, in the course which the candidate wishes to attend, ana only when the applicant has previously undergone a regular course of studies of the length and type generally prescribed. The decision of ther Courcil of Faculty shall be final with no right of Appeal. 6. — The examinations shall take place at the University and shall determine, with particular regard to the Faculty which the candidate wishes to attend, if the probationer has the humanistic or technical-mathematical training necessary to follow the University courses. There shall be oral and written tests. The probationer shall also be required to prove to have a sufficient knowledge of the language to derive a benefit from the lessons. 7. — Candidates shall be required to undergo the examinations under the supervision of a commission appointed by the Dean of the Faculty who may also use for that purpose, local high school teachers. ’ 8. — The examinations undergone under supervision of the a/m commission aie to be considered only as a test, valid for the enrollment in a particular Faculty of the Univeistity of Trieste ; they are not to be considered as school certificate and shall not entitle the student to any diploma or certificate. 9. — These matriculation examinations shall only be held at the beginning of each academic year and not later than 31 January. 10..— For the initial application of the provisions herein, the University may open a matriculation examinations term during academic year 1947/1948 in order to settle the status of foreign students conditionally enrolled. 11. — The regulations on details of examinations shall be issued at the beginning of each academic year in an Order to be published by the Rector after having consulted thé Academic Senate and with approval of Education Office, Allied Military Government. Army Director General, Civil Affairs Order No. 155 DECLARATION OF PUBLIC UTILITY AND NECESSITY OF THE SCHOOL-BUILDINGS GROUP AT S. SABBA WHEREAS it is deemed urgently necessary for public purposes to construct a group of school-buildings at S. Sdbba, comprising an elementary and a maternal school according to the scheme drawn up by the Public Works Office of the Commune of Trieste ; WHEREAS in order to accomplish this project it becomes necessary to occupy private property, since the Commune-owned grounds are unsuitable owing to their position and sanitary reasons ; and WHEREAS the project concerning the said group of schools has been approved by Allied Military Government; NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army, Director General, Civil Affairs,1 ORDER: ARTICLE I DECLARATION OF PUBLIC UTILITY 1. — By the terms of this Order, the reclamation of private property is hereby declared to be of urgent necessity and of public utility and interest, for the construction of a group of school-buildings at S. Sabba, to comprise an elementary and a maternal retool as more specifically described and designated on a certain map, as Nos. 1, 2, 3 and 4, annexed hereto, and made part of this Order as set forth in Article II herein. 2. — The above declaration shall have all the effects of the law in force on 8 September 1943. ARTICLE II VALIDITY OF THE MAP AND ITS DEPOSIT The annexed map, mentioned in the foregoing Aiticle, constitutes an integral part of the present Order and has been deposited with Allied Military Government in the Office of the Department of Public Works, Trieste, and also in the Public Works Office of the Commune of Trieste, where same may be freely inspected by all interested parties. The said map.is marked „Annex A“ and shall be made a part of this Order. ARTICLE III EFFECTIVE DATE This Order shall become effective on the date it is signed by me. Army Director General, Civil Affairs Order No. 185 FULL OWNEESHIP (REQUISIZIONE DEFINITIVA) TO FORMER REQUISITIONED VEHICLES WHEREAS, an Order is required in accordance with Article II, Order No. 225 dated-7 January 1947, to vest full ownership of vehicles requisitioned by Allied Military Government; and WHEREAS, it is now desired to acquire full ownership to all said ■requisitioned vehicles tvhich have not been returned to the „Ispettorato“, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U.
