Army Ref. : LDfA\51\VM Director General, Civil Affairs Order No. 179 REGULATIONS FOR MOVEMENT OF PERSONS INTO AND OUT OF THE BRITISH-UNITED STATES ZONE OF THE FREE TERRITORY OF TRIESTE WHEREAS it is advisable to issue new provisions controlling the movement of all persons entering and leaving that part of the Free Territory of Trieste administered, by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I. Army, Director General, Civil Affairs, ORDER: ARTICLE I CONDITIONS FOR ENTRY AND EXIT INTO AND FROM THE ZONE Section 1. — Subject to the right of the Allied Military Government to exclude or expel from the Zone, at any time, anyone who may be unacceptable, any person, may enter or leave the Zone through the control points specified in the Table annexed to this Order, provided that he is in possession of (a) a valid Italian passport, or i n the case of Itali an citizens entering or leaving the Zone directly from or to the Republic of Italy, a valid document of identification recognized as such under the Laws of the Republic of Italy ; or (b) a valid entry permit or Allied Forces Permit issued by the appropriate Allied Authority together with a valid passport ; or a valid internationally recognized travel document for stateless persons ; or (c) a valid Resident Identity Card issued by the Jugoslav Military Government for that Zone of the Free Territory of Trieste administered by said Government ; or (cL) a valid passport on which has been entered by a British or United States Consulate a visa authorizing entry into the Zone ; or (e) a valid Seaman’s document .of identity together with documentary evidence that he is travelling in the course of his duty ; or (f) a valid passport or identity card issued by the Republic of S. Marino ; or (g) a valid passport issued by any of the following countries : Austria Belgium Denmark Eire France Federal Republic of Germany Greece Iceland Luxemburg The Netherlands Norway Portugal Principality of Liechtenstein Sweeden Switzerland Turkey United States of America United Kingdom Australia Canada Ceylon Colony of Southern Rhodesia India New Zealand Pakistan Union of South Africa In lieu of a Passport for German Nationals or Bundesrepublik Deutschland Reisepass a Temporary Travel Document shall be sufficient. Section 2. — Any person, other than those specified in Section 1 hereof, who desires to leave and re-enter the Zone may be permitted to do so provided that he is possession of (a) a valid Special Indentity Card issued in accordance with Allied Military Government Order No. 112 dated 7 January 1948 ; or (b) a valid Permanent Resident Indentity Card issued by one of the Communes under the laws of the Zone. DUAL PROPERTY OWNERS’ CROSSING PERMITS Section 1. — Any owner or tenant of agricultural immovable property lying within ten kilometres from the border between the Zone and Jugoslavia, who permanently lives on the other side of the border and within ten kilometers therefrom, may obtain for himself, his relatives and workmen, a dual property owners’ crossing permit. The possession of the said dual property owners’ crossing permit will entitle the said owner or tenant and their relatives and workmen to enter and to leave the Zone at the crossing place stated in the permit for the purpose of exercising their rights of ownership or tenancy. Movement, however, must take place between sunrise and sunset, and dual property owners’ and others as inscribed in said permits, who cross the border, must return the same day on which they cross the border. Section 2. — The provision set forth in Section 1 of this Article shall not be applicable to those owners and tenants who have acquired their rights to the property after 15 September 1947, except for such owners and tenants as have acquired the ownership or property rights by way of inheritance or by legal act of transfer to an heir of the family who would have inherited such property or property rights on the owners’ death. ARTICLE III TRANSIT Section 1. — Any person requiring to pass through the Zone from one country to another shall be permitted to do so if in possession of a valid travel document, together with a visa or other authority to enter the country of destination. Section 2. — Should persons in transit desire to leave the transportation or the station or port they must be in possession of one of the documents specified in Article I hereof. ARTICLE IV ISSUANCE OF PERMITS The Entry Permits, Allied Forces Permits, dual Owners’ Crossing Permits and visas in lieu thereof will be issued in accordance with regulations to be issued from time to t:me by Allied Military Government (Military Permit Off’ce). ARTICLE V AIRCRAFT No aircraft may land in the Zone except by permission previously obtained from the Director of Interior, who will determine the conditions and the area for landing. PENALTIES Any person who ; (a) makes a false statement, knowing the same to be false, in relation to application for a permit to enter the Zope or who furnishes false documents or writings in relation thereto ; or (b) who enters, leaves or re-enters the Zone and is not in possession of the documents required under this Order, shall be guilty of an offence and shall, on conviction by an Allied Military Court, be liable to fine or imprisonment or both as the Court shall determine. ARTICLE VII INSCRIPTION IN THE PERMANENT POPULATION REGISTER No person permitted to enter the Zone ;n terms of this Order shall acquire any right to be inscribed in the permanent Population Register of any Commune within the Zone. ARTICLE VIII REPEAL OF PREVIOUS ORDERS Order No. 181 dated 31 August 1949, Order No. 204 dated 22 October 1949 and Order No. 63 dated 12 April 1951 are hereby repealed. WHITELAW, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I Article VI of Order No. 11 dated 31 August 1945 is hereby repealed and substituted by the following new Article : „ARTICLE VI „ The Office of Industry and Commerce shall apply to Allied Military Government on „request all statistics and data affecting the economic life of the Zone. The Office of Industry „and Commerce may also act as Secretariat to the Chamber of Commerce Industry and Agriculture upon request of the President of the Board („Giunta“) after approval by the Chief „of the Department of Commerce, Allied Military Government.“ ARTICLE II In addition to the members specified in Article VII of Order No. 11 dated 31 August 1945 as modified by Article I of Order No. 106 dated 23 May 1950 there shall be appointed to the Board of the Chamber of Commerce, Industry and Agriculture of Trieste a representative of Artisans and a representative of Direct Cultivators.
