ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 115 INDEMNITY TO CLERICAL PERSONNEL, SUPERVISORS AND FOREMEN OF SELAD AMENDMENT TO ORDER No. 197/1951 WHEREAS it is deemed advisable to amend Order No. 197, dated 31 December 1951, in that part of the Free Territory of Trieste administered by the British United States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, CB, CBE, Major General, Zone Commander, ORDER: , ARTICLE I The last part of the first paragraph of Section. 2 of Article VII of Order No. 197, dated 31 December 1951, is hereby amended as follows: „Clerical personnel, supervisors and foremen shall receive the same indemnity increased, „according to their respective duties, from a minimum of 12.50 Lire per hour or 100 Lire per ,,8-hour working day up to a maximum of 56.25 Lire per hour or 450 Lire per 8-hour working „day.“ . WINTERTON Major General Ref. : LD/AI53I131 Zone Commander Order No. 116 PROVISIONS CONCERNING THE SUSPENSION OF CLAUSES PROHIBITING SUB LEASES WHEREAS it is considered advisable to suspend the clauses prohibiting sub-leases, in that part of the Free Territory of Trieste, administered by the British-United States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I The clauses prohibiting sub-leases contained in extended lease-contracts concerning flats for dwelling purposes, with restriction to sub-leases of a part of the flat only, are hereby suspended until such a date as will be established by a subsequent Order. ARTICLE II This Order shall become effective on the date of its publication in the Official Gazette and shall be operative as from 1 January 1952. Dated at TRIESTE, this 25tli day of September 1953 Ref. : LD/A/53/128 Order No. 117 PROVISIONS CONCERNING SOCIAL INSURANCE OF PERSONNEL OF CONSUMER-TAX ADMINISTRATIONS („GESTIONI DELLE IMPOSTE DI CONSUMO“) WHEREAS it is considered advisable to issue provisions concerning the social insurance of personnel employed in Consumer-Tax Administrations („Oestioni dette Imposte di Consuma“), in that part of the Free Territory of Trieste administered by the British-TJnited States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, CB, QBE, Major General, Zone Commander, ORDER: ARTICLE I Section 1. —• In addition to the contribution mentioned in art. 2 of R.D.L. 12 May 1938, No. 908, converted into the-Law 19 January 1939, No. 264, and in the subsequent legislative provisions and regulations concerning the social insurance treatment of personnel employed in Consumer-Tax Administrations („Gestioni appaltate delle imposte di consumo“), a temporary extraordinary contribution amounting to 2.37% of the. earnings received by said personnel shall also be due. Section 2. — The contribution mentioned in the foregoing Section shall be destined : a) to balance the burden relating to the settlement of „contribution positions“ („posi-zioni contributive“) — concerning the years 1945, 1946, 1947 — of insurances for direct and family pensions of the personnel inscribed in the Social Insurance Fund („Fondo di Previdenza“) in terms of R.D.L. 12 May 1938, No. 908 ; H. WINTERTON Major General Zone Commander b) to balance the burden relating to the settlement of „contribution positions“ („posi-zioni contributive“) — concerning the same years — of mixed life insurances as well as to balance the higher burden at the charge of the Integration Fund („Fondo di Integrazione“) referred to in art. 34 of the Regulations, approved by R.D. 20 October 1939, No. 1863, as amended by Article IV of Order No. 9, dated 20 January 1949, deriving from payment of the seniority indemnity in favour of any such personnel ceasing service with effect from after 31 December 1950, such indemnity being paid at the rate established by the National Collective Labour Agreement relating to subject category. ARTICLE II Section 1. — For the period between 1 January 1952 and 31 December 1955, 1.34 percent of the above mentioned contribution shall cover the burdens indicated under letter a), whereas 1.03 percent shall balance the burdens indicated under letter b) of foregoing Article I. Section 2. — For the period from 1 January 1956 onwards, the contribution, in its entire amount of 2.37 percent, shall be destined to balance the burdens indicated under letter b) mentioned in Article I above. ARTICLE III Section 1. — The extraordinary contribution mentioned in foregoing Article I shall be at the charge of the employers and, as far as its payment is concerned, the provisions of art. 2 of R.D.L. 12 May 1938, No. 908, as subsequently amended, shall be applicable. Section 2. — The said contribution shall be due for the duration of eight years. However, if the purposes mentioned in Section 2 of Article I have been attained prior to the lapse of such period of time, the extraordinary contribution shall no longer be due. In such case, an Allied Military Government Order shall determine that the burdens for which the contribution is destined have been balanced. ARTICLE IV The provisions of Order No. 52, dated 28 March 1950, shall cease to be effective as from 1 January 1952. ARTICLE V This Order shall become effective on the date of its publication in the Official Gazette and shall be operative as from 1 January 1952. Dated at TRIESTE, this 28th day of September 1953. H. WINTERTON Major Genera) Ref. : LD/A/53/88 Zone Commander Order No. 118 INCREASE OF POST-SANATORIUM INDEMNITY FOR TUBERCULOSIS PATIENTS ASSISTED BY „CONSORZI ANTITUBERCOLARI“ WHEREAS it is deemed advisable to increase the rate and the duration of the post-sanatorium indemnity set forth by Order No. 14, dated 20 September 1947, in that part of the Free Territory of Trieste administered by the British- United States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, OB, GBE, Major General, Zone Commander, ORDER: ARTICLE I Section 1. — The rate and duration of the indemnity payable as post-sanatorium assistance, provided for under Order No. 14, dated 20 September 1947, as amended by Order No. 361, dated 3 November 1948, are hereby amended as follows : heads of family: 500 lire daily for the period of one year ; non-heads of family: 300 lire daily for the first six months, 200 lire daily for the subsequent six months. Section 2. — The indemnity shall be payable to assisted persons who have been hospitalized for a period of not less than two months and who have been discharged as a result of clinical recovery, of „stabilization“ or in order to continue the cure in consulting rooms. Section 3. — The payment of the indemnity shall be limited to nine months if the period of hospitalization does not exceed six months, inclusive of any periods of cure in consulting rooms. Section 4. ■— The post-sanatorium indemnity shall not be payable to those who ask for voluntary discharge from health-establishments „luoghi di cura“ or to those discharged on disciplinary grounds. Section 5. — Any assisted person accepting a paid work or refusing, after the lapse of four months from his/her discharge, an occupation adeguate to his/her conditions, shall forfeit the right to the post-sanatorium indemnity. , Section 6. ■— The post-sanatorium indemnity shall not be payable for those periods during which the assisted person enjoys post-sanatorium assistance in appropriate health-establishments or establishments for re-education to work. ARTICLE II The provisions set foth in Article II of Order No. 14, dated 20 September 1947, are hereby repealed. ARTICLE III The burdens deriving from the application of this Order shall be at the charge of the Budget of the Zone. This Order shall become effective on the date of its publication in the Official Gazette and shall be operative as from 29 April 1953. Dated at TRIESTE, this 28th day of September 1953. H. R.
