The article addresses the issue of protection of indication of geographical origin (IGO) for wines that are not protected under Regulation 1308/2013. Based on the study and detailed substantial analysis of the applicable provisions of Slovenian and EU legal acts, stances of the leading theory of IGO law, trademark and competition law, and the case law of the Court of Justice of the European Union, the author concludes that there are many other, alternative ways of protecting IGOs for wines, which are not protected under the direct protection system. For qualified IGOs for wines that do not meet the conditions for protection under Regulation 1308/2013, as well as for simple IGOs, protection should be sought within other branches or institutes of law. Alternative options for protection include collective trademark, protection against unfair competition, labelling law, advertising law, and consumer protection law.
