The article discusses the legal situation and the role of an insurance broker as an adviser to the insurer when concluding insurance contracts. The author draws attention to the legal regulation of insurance agents under EU law and the future amendments to the Slovenian Insurance Act. It exposes the insurance broker liability issues towards the insurer and the insurance company, in particular his duty to protect the interests of the policyholder. It also discusses issues relating to the insurance broker performance commission, traditionally paid by the insurance company. The insurance broker conducts the insurance brokerage business in its own name and for its own account and is independent of the insurance companies. Several different types of insurance intermediaries, such as specialized brokers, independent agents and auxiliary agents and others, can be distinguished in practice.
