One of the basic human rights is the right to a fair trial which is also protected by the Article 6 of the European Convention on Human Rights. European Court of Human Rights recently delivered a few judgments on respect of this right in the proceedings before the constitutional court. In the case of Milatova and others v. the Czech Republic the Court ruled that that written submissions of one party to the proceedings before a constitutional court must be served on its opponents. In two other cases the Court underlined the requirement of impartiality of the constitutional court judges and emphasized the principle of objective impartiality of the Court. In addition, the Court considered two decisions on compliance with the requirements for lodging a constitutional appeal which breached the applicants' rights to access the court.
